Indonesia & Corruption: a few articles in the past few weeks

This another alleged bribery case involving the Case at the supreme court, Zarof Ricar. This only emerged after the Robert Tanur Case (post #179) surfaced. His assets! IDR1T+https://www.cnbcindonesia.com/news/...arof-ricar-makelar-kasus-beraset-rp-1-t-lebih

It is worth noting, that although the Supreme Court overturned the lower court's decision that found Robert Tanur not guilty in a murder case (allowing him to walk free), it only sentenced him to five years in prison. Experts commenting on similar murder cases have suggested that sentences usually range from 15 to 20 years.

"In this case, Lisa (the defendant lawyer) asked Zarof to try to get the Supreme Court Justice to still declare Ronald Tannur not guilty in his cassation decision. Then, according to the notes, Lisa told Zarof that she would prepare funds of Rp 5 billion for the Supreme Court Justice and Zarof would be given Rp 1 billion for his services."

"investigators from the Attorney General's Office also found more than Rp920 billion in cash and 51 kilograms of Antam gold at Zarof's house in Senayan, Jakarta."

This raises questions: if a single member of parliament could allegedly bribe so many individuals with such vast amounts of money, what about other members of parliament and those in positions of power? It is especially concerning as this individual was formerly a member of parliament, someone who once helped shape the laws. In addtion both lower courts and the Supreme Court, Indonesia’s highest judicial authority, handled the case are getting involved
Why do you think the majority of DPR, Governors , Mayors, and other top positions want to go into deep debt to get elected? They know the rewards will more than cover any debt. Show me any legislation that hasn't been influanced by rewards of the personal kind? If one happens to lose an election, no problem. The government will supply phycological services.

Sounds like all governments around the world!

Another potential of mega corruption case. "the appearance of mysterious’ sea fence spanning 30km".

https://www.thejakartapost.com/indo...ea-fence-that-sparked-reclamation-debate.html.

It wouldn’t attract significant media coverage or become a controversial issue requiring parliamentary attention if it were merely a typical sea fence or defense. However, behind this lies an alleged scheme involving trillions in corruption and the theft of government assets by major developers and property businesses, all at the expense of the Indonesian people and government. These entities already hold SHM and HGB rights in the area. All they need is to partially reclaim the sea to build beach front exclusive residence, Business centre, hotels and/or as part of a wide leisure centre project. Additionally, the project obstructs fishermen, forcing them to take longer routes around the sea fence to catch fish.

As often pointed out, Indonesian tycoons struggle to compete internationally because their success sometimes relies on illegal or alleged illegal practices that are difficult to replicate in other countries. In general, it is relatively easy for individuals to become multimillionaires by exploiting the country's abundant assets.

What amazes me is how so many illegal projects get so far into their construction before the problem is brought to the public's attention? How could they not see 30+ kilometers of a sea fence already constructed? Also the huge project in Ubud, Bali already constructed by Russian, German, and wealthy Indonesian people, before the authorities say there is a problem. I thought usually all projects had to have all necessary permits, before any construction is even started?

They only take action when a case goes viral. However, this case has already gained widespread attention.

The sea is not something anyone can own in Indonesia. Considering Land they could get by partially reclaiming the land, beach front they could own, it is huge amount of money. The fact that they managed to obtain so many SHGB and SHM suggests that many parties are involved, and they have remained silent about it for obvious reason.

Did you notice the difference between the villa in Bali and this sea fence?

The German investor was identified and arrested while the owner of the sea fence is not.

No news about who owns the sea fence. And who are responsible for issuing the HGB and SHM. Will they ever be caught, arrested, fired from their positions?

Only churches and even with all the permits construction may not get past the first brick.

Sadly it is the same old story. If there is a problem and a foreigner is involved, it is the foreigners fault. Such as a motorbike accident. There is the assumption that all tourist are rich, because we can afford to travel, and come here. Yes we make more money in our home countries, but our cost of living is much greater also!
I tell my local friends, how even in our more wealthy countries, we have homeless people living on the streets. Something they can't believe or understand.
There are people from Indonesia that are very wealthy. But because of the ability to pay off bribes, or some call it corruption, these wealthy local people find a way out of trouble.
The problem is Greed, which is universal. People thinking only of money in their pockets Now! Sadly, not thinking of preserving the Earth's resources for generations to come.

I could easily see the difference, my reply is about the previous comment regarding the topics put forward in this thread e.g illegal ownership of the sea and the construction of sea fence in the previous post.

Several hundred land certificates have been issued, covering around the sea fence, but so far, only around 50 have been revoked. What about the rest? It is possible that once public attention diminishes, these activities might resume. Additionally, it is not impossible that if the case reaches the Supreme Court, the individuals involved could win against the government. Similar outcomes have occurred in the past.

The news this morning is that Indonesia, Bali particularly is stepping up their search for international (foreign) owned businesses for compliance to local and national regulations. No mention of locally owned businesses.

https://www.suarasurabaya.net/kelan...lik-pagar-laut-didenda-18-juta-per-kilometer/ Minister of Marine Affairs and Fisheries: Sea Fence Owners Fined 18 million per Kilometer

Considering the sea fence stretches 30.16 km, the fine they face is only Rp542.88 million, can you believe that?

Meanwhile, land prices in PIK 2 range from Rp20 million to Rp35 million per square meter. Once this reclaimed sea area transforms into a beach front residential and leisure center, its potential value will be around this.

So does this mean that whoever owns this sea fence owns the beach behind it? Which means property! Please clarify what all this means? Are they getting land for a super cheap deal?

The sea fence serves to mark and assert ownership. Positioned about 500 meters from the shore, reclaiming the area would not be costly like in the middle of the sea. While no one can technically own the sea, they have already secured SHM and SHGB for certain sections around the fence. Allegedly all of of their cost of just to build the bamboo fence for 30.16km long and they will get the land from the fence to the seashore after reclaiming the sea.

Once the reclamation is completed, the land could become beachfront property, potentially integrating with PIK (Pantai Indah Kapuk) as an exclusive residential and recreational resort. The land could be sold at a price range of approximately Rp20 million to Rp35 million per square meter, similar to PIK.

After gaining public attention and going viral, they will only face a fine of Rp18 million per kilometer of fencing. Given that the sea fence extends 30.16 km, the total fine amounts to just Rp542.88 million.

In comparison, the potential profits could reach thousands of trillions of rupiah if the project had proceeded without public reaction. With such a minimal penalty for such massive gains, who wouldn’t be willing to take the same risk for a similar project in the future?

Head of Tangerang land office and other associates are removed from positions and sanctioned (fired?).

It is already clear that the owner of the fence is the Agung Seday Group or their surrogates, which they confirmed.

Now this scary! So if they own the land under the water from the fence to the shore, then all they have to do is bring in soil and creat new land for cheap, and then build on it, like what they've been doing in Dubai and Abu Dhabi. Sorry if my locations are wrong, but you catch my drift.

Interesting to read about the Agun g Seday Group and its principal Sugianto Kusuma. Wikipedia reports that: " In December 2015, according to an investigation by the Corruption Eradication Commission , members of the provincial parliament gathered at the residence of Sugianto Kusuma. It is alleged that during this meeting, Kusuma influenced senior provincial legislators to pass a spatial planning law without provisions for increased land contributions. Several witnesses, as reported by the press, claimed that the developer offered sums ranging from Rp2.5-5 billion to each member of the parliament who voted in favor. Kusuma and his son, Richard Halim, have been questioned by the KPK several times, and were placed under an international travel ban in April 2016, which was finally lifted in October 2016."

Prabowo has often spoken about the need to eradicate corruption and it will be interesting to see how this develops as apparently it was Prabowo ordered the removal of the controversial sea fence to reclaim land. Will Sugianto Kusuma be prosecuted?

I believe the law states that no one can own any coastline until above the 15 meters above the high tide mark. No private beaches allowed.
