'Golden Visa' Ministerial Decree 22/2023

GOLDEN VISA has been available on molina and evisa official Indonesian immigration websites for sometimes now. So officially people who think they could meet criteria will be able to apply. Typically it is granted for 5 or 10 years. It is available through three routes:

Global Talent E33 Index
E33A, E33B, E33C – Global Talent, world leader, typically via invitation and collaboration. There is no requirement to tie to investment. One of the people who have received the Indonesian Golden Visa is the CEO of OpenAI, Samuel Altman.

Retirement Route
E33E Silver Hair, retired person with a pension of US$3,000+ per month, deposits US$50,000 in an Indonesian state-owned bank. US$3,000+ is well above the taxable income threshold in Indonesia. The major disadvantage of this scheme is that because Indonesia taxes its residents on their worldwide income, including income and pensions earned abroad. So with this income, someone might need to pay income tax in Indonesia even if their pension is withdrawn from abroad.

Investing Route: E28B, E28C, E28D
E28B: establish company
E28C: Purchase a bunch of Bonds and Shares
E28D: Corporate Investor to Establish Branch and Subsidiaries in Indonesia

Good Question. Based on the report he is the first who got a golden visa. Whether he applied for it or granted via invitation is not clear. The Indonesian authorities might have used the opportunity to offer him an Indonesian Golden Visa when he visited Jakarta to give a talk on AI last year. He needed a clearance to enter Indonesian territory to give a talk anyway.

The Golden Visa is distinct from residency visas like ITAS/ITAP. Tax residency, and thus liability for global income taxes, is established only after spending 183 or more days within any 12-month period in Indonesia. Having accepted the Golden Visa offer, might be with the assistance of his advisor, he has nothing to lose as he does not need to pay any tax in Indonesia on his worldwide income until he decides otherwise. Maybe they gave him some paper he even does not know he got the "golden" one.
 
Spain plans to eliminate a “golden visa” program that allows wealthy non-European Union citizens to buy residency rights by investing 500,000 euros or more (about $540,000) in cash in real estate, Prime Minister Pedro Sánchez said.
