HELP!: School forced EPO thru Imigrasi this week.

LET ME POST THE OP (from old forum, but slightly updated) AND SUBSEQUENT FEW AFTER HERE:



They terminated. I began mediation complaint with Depnaker two weeks ago. Must leave? Date for meeting confirmed by both sides through Depnaker.


School in SE Jkt asked me to resign several times, I didn't. Letter on Friday, on door, from school reads, "Get your passport, EPO and ticket at school counter". It contained an itinerary for flight out (40 hour trip) mid next week.

I began mediation proceedings through Depnaker Jkt Central, immediately after the school sent a termination letter two weeks ago. They have contrived up a story that I haven't been compliant to their requirements (never given a warning letter on this). In all fairness, I had been sick for two weeks with pneumonia, but upon return completed all work for the quarter and semester (to their chagrin apparently). Seems plans had already been set in motion while out, but contract states that after three continuous weeks of illness they have the option to terminate. They had given one warning letter stating I needed to be caught up by a certain date, and I complied, but the KS seemed rather ticked that I was able to do that (several sleepless nights and arriving at work at 4-5am to catch up).

They then began to act sort of nasty and disagreeable with everything, even a few lies thrown in by the supervisor then. They wanted me out, but if I accepted the resignation pushed on me it meant I was liable for an assortment of fines and costs over the duration of the contract. The next day the VP and KS had it out with me in front of twenty teachers in the staff room, complaining about things that didn't need to be complained about. All work was completed. Finally, as the KS was berating me the VP stepped in and said "Finished", pointed at the door and abruptly left with KS to her office in the other direction. I sat at my desk for a half hour stunned. Had I actually just been fired? After 30 minutes and not a peep from any of my superiors I packed up and left. HR person called me just after I left the outer perimeter gate, "You must return and leave after we are done, and you must leave the correct way." I, 'The VP just said I was finished Mrs. If he does want me to return, then have him call me." Within an hour of this my school email was cut. Yep, I was canned. Off to Depnaker shortly after.

I was visited by Bekasi Imigrasi agents this past Tuesday. I showed them the mediation date that has already been set by Depnaker and they asked me to come to the kantor with passport, kittas, etc, anyhow and give my side of the story the next day.

This was typed up and checked. Twice the info was incorrectly quoted by the officer in Bahasa. I handed over my passport, as told I must do (given a receipt). Then left. Today the school planted a letter on my house door which basically says to come get my passport, EPO and ticket out.

I have received the request to attend the mediation at Depnaker and the school has received theirs also.

The school reps kept coming to my house banging away and yelling for a few days. I showed all the govt paperwork to the perumahan security guards and a school agent that was arriving there also (to deliver me to the school), on New Years Eve afternoon. The guard assured me they wouldn't be allowed to come in again.

Question one is, can the school do this? Or rather, can Imigrasi do this?

I said at the interrogation that it appears by the hukum/law that I must stay in the country and conclude my mediation first (30 day limit I've read). They didn't seem to agree and said, "We can make you go as we wish, we are able to investigate it ourselves and determine if you must leave".

Question two, Is there some law I can quote which says that I must stay in country when there is a Depnaker (or any govt entity involved) mediation date set?

It apparently would go to the Industrial Court next, if both sides could not find agreeable terms. Mediation date is for early January 2017. The school received their request to come yesterday, from Depnaker, as did I. My ticket out in a few days and EPO with passport are waiting at the school. Should I ignore this and stay in country to conclude Depnaker court case/mediation, despite Overstays? Is the school still responsible for me until I'm actually out of country, regardless of EPO?

Is there a higher-up at Imigrasi Bekasi/Jkt I can visit to plea my need to stay? One Imigrasi officer from Papua (finalizing my interrogation) was really nervous when I went from his office directly to the larger main building there with waiting room. I went in to use the restroom and then sat down to order a taxi. He rushed in through the door and spotted me and said panting and nervous, "Where, what, you..!". I said hi again and said, 'WC pak, WC'. He said, "WC, okay, WC. Ya, WC.", calming down finally and stepped back out, pulling his hp out as he did so. Hmmm, kinda odd ya?


I am in disbelief that the school can be so closely related with the imigrasi dept in Bekasi to be able to force my EPO when Depnaker has already set a mediation date, but I have been teaching here for 15 years and I've witnessed almost all sort of unbelievable things happen though.

Apologies if this has come up before. I have spent several hours trying to find a similar situation that may have occurred and been reported here, but still haven't found anything yet.

Ticket out is back to other side of the planet. Indonesian wife and kids are quite upset razzled. I stand to lose ~300jt on this, holiday has been pretty sad around the house. At least the school monkeys won't be banging at the door again and peeking through our windows and yelling my name out like psychos for an hour. "MisssssTerrrrRRR SuuuuushiiiiII!"

Welcome to Expat Indo forum. I unfortunately do not have much time today as you certainly imagine but I promise to be back to your thread as soon as possible. However there are a few answers and advises I would like to give you right now.

They can. Definitely. Worse, they MUST do it (terminating your KITAS) and they MUST do it as soon as they've terminated your contract and this, regardless of the fact that there is a mediation.

A KITAS is granted to you through the sponsoring of a company. Should the contract being terminated, the residency permit should also be terminated even if the school has not complied with their obligation since the reason supporting this residency permit does not exist anymore.

Also, the company needs to get this permit terminated in order to be able to replace you and have both an IMTA modified (to the name of a new employee) and a new permit issued.

Don't get me wrong, it doesn't mean that you can not attend the Nakertrans mediation.

Keep in mind that you are not obliged to accept to fly to your native country and use the ticket provided. You are "just" required to go out of the country since your stay permit is void. If you are looking to an economical way to get out and back in, just fly to Batam early morning, then jump on the first ferry to Singapore and you can be back the same way on the same day with a VoA allowing you a first 30 day period in the country.

I understand that it is not what you want to hear but you are seriously mistaken in believing that you are allowed to stay in Indonesia on a permit sponsored by the school after that your contract has been terminated and that Imigrasi has terminated your permit. If you overstay, you put yourself on the wrong side of the law. As I said earlier, you have heaps of solutions (especially being married to an Indonesian) to come back and stay to attend your mediation ON A NEW LEGAL PERMIT.

As explained above. They are absolutely correct. You can not remain in Indonesia on the permit sponsored by the school once the work contract is terminated. Remember: 1 IMTA = 1 KITAS. In order to replace a terminated or resigned worker a company MUST have the ITAS terminated in order to have a new one issued for a new worker. Should the mediation last for months, if the residency permit is not terminated, it means that the company wold not be able to employ a foreign worker for this laps of time. Again, nothing forbid you to exit and come back immediately on a different visa/permit.
I understand that this means unplanned costs but it is what has to be done and it is a pity that you've find us only lately. Acting as soon as you get informed that you had an EPO for your permit would have not only reduced your costs but also offered you a wider range of solutions, like coming back on a VITAS sponsored by your Indonesian wife for example, rather than on a VoA.

No, there are no such law and this for many reasons, the two main one being as follow:

  1. Nothing forbids you to be represented by a lawyer if you can not attend yourself
  2. Nothing forbids you to re-enter Indonesia. An EPO is not a blacklisting.

Keep in mind that UU 13/2003 (Manpower Act) has been drafted for workers who are WNI in their huge majority and who therefore doesn't have the problems foreign workers may have when their contract is terminated. I would need to re-check my figures but I believe that TKA are only something like 0,028% of the total number of workers in Indonesia, not enough for the DPR or government to issue a bunch of regulations. The case of terminaison of contracts for foreign workers and the issues it creates for residency permit has been ignored by legislators.

If the school has not done its job properly when it comes to the payment of what is due to you they have been pretty smart and sharp in addressing the EPO issue. By sending to you people to inform you that your passport and EPO was waiting for you they have saved them from a lot of potential troubles.
Should you overstay, would they be financially responsible if you are unable to pay for the overstay? Technically yes, but if they are as smart as they have been in addressing your EPO, they won't pay and wait 60 days that no fine is due anymore and that you get deported (no cost for them since they've already paid for your ticket) and blacklisted.
Be aware that if you overstay (meaning if you stay in Indonesia without a valid permit) more than 60 days, there are no fine (the Rp 300.000 / day) BUT you are deported and blacklisted.

It is very important that you realize that you look at the problem from the wrong angle. Your "need to stay" is understandable but you have no way to explain that you did not respect Indonesian law by not going out of the country once the permit has been terminated and re-entered on a different permit. You MUST go out in the delay given by the EPO (usually 7 days after issuance). Again I understand it is unfair because it generates unnecessary cost but it is the way it works.

They did not force the EPO. They've just done what they should have done. Once a contract is terminated, with good or not so good reasons, they have to inform imigrasi (which they have done) and Imigrasi must terminate the residency permit, leaving 7 days to the foreign worker to pack... or to organize his/her return on a different permit.
Any cost occurring following an illegal decision of terminating a contract can be claimed in Court... but that is if you enjoy and trust Indonesian Civil Courts. I don't.
As much as I believe that you may have a ground for any salary, THR,...etc due, I wouldn't advise you to take a lawyer to sue the school over the cost their silliness had for you.

Apologies if my answer is not as complete as I would wish... it's January 1st and weather has been awful last night in Manado. Need to wake up the kids to fire the petasan and kembang api we were unable to fire last night.

I took time to quickly have a look at the link to the old forum.


  1. Leaving the country would not null the mediation. It's unrelated. Asking to pospone the mediation to a date allowing to do your visa run, would also not null it and is the better thing to do. Be aware that there are good chances that representatives of the school ignore the invitation anyway, or ask for a report claiming they need time...etc
  2. You shouldn t put to much hope on the fact that they may be financially liable, being your sponsor, concerning your overstay. As I said before, and in line with article 78 uu 6/2011, they just have to wait 60 days to put you in misery and avoid to have to pay anything linked to an overstay. As per article 78 UU 6/2011 states if your overstay exceeds 60 days you, no overstay fine is due BUT you are deported and blacklisted which I am sure you realise would not help you to get the due salaries.
  3. Not collecting your passport and ticket would be imho a mistake. The school would have no problem to prove that it did all it was possible to do, sending twice people to inform you about it, to inform you that they were available for pick up. Therefore they will reject the responsibility of the overstay on you, and you alone. Claiming that you were not aware of the law and procedures would be of no help.
 
I would advise to exit and come back on a sosbud visa sponsored by your wife- maybe a bit more expensive than a VOA but will likley save in the long run, because you can go on to process a spouse sponsored ITAS from that- whereas you can't from a VOA.
The quickest way I know of is with a visa agent in Singapore. Probably one or two nights stay in S/pore depending on the flight timings.
You will need Passport, Copy of sponsor's KTP (back & front) a sponsor letter claiming responsibility for you... etc I am sure you can find all the details somewhere in the forum.
The agent I used to use was hana express - they were always helpful and efficient.
The last time I processed this type of visa I was told to ensure that the sponsor's signature looked "the same" on their KTP as on the sponsor letter.

So to recap: I would do as atlantis suggests and get my passport and other documents, get things in order to process a new visa (not a lot/nor complicated), call up the agent in S/pore or email them to double check the required documents/ prices & get my bum over there & then come back with my shiny new permit that will allow me to follow the spouse sponsored visa routes.
That way you and your family are protected from such (employer controlling your residence) hassles in the future.

If time is of the essence & money is enough to cover 2 exit trips, then head out & come back in on a VOA .. then you have a couple of months (30 day entry plus 30 day extension ** but no extension on a free VOA) to get things sorted out.
Personally I would just ask family/a mate to loan the cash and get the sosbud. Just be sure to check on holidays etc before you book flights.



I hope I make sense with my ramblings, apologies if not.

*Once on a spouse sponsored itas (probs a couple of months down the line at most) you are permitted to work- and there is a hell of a lot of work out there. So don't fear too much about that- all you need is a decent personality (to procure work) and the ability to do the job.

Yeah, you should try to do a Social Visa sponsored by your wife. This has 2 benefits: 1. Extendable up to 6 months (first time validity is 60 days, then extendable 4 times, 30 days each). 2. You can convert to wife sponsored KITAS if so inclined.

If you use an agent in Singapore, they can turn this around in 1 day. When I did it some time ago, I handed them my passport in the morning, and it was back in my possession by around 3 pm.

You need to produce a passport with 6+ month validity (you'll need this anyway, if you want to return on VOA or visa waiver), sponsor letter from the wife, copy of wife's KTP, and marriage certificate.

a few tips re the S/pore agent/visa route...
usually you have to have the p/port & documents with the agent by about 10 am.
the trip from the airport to Orchard area is say 30 minutes.
so aim for an early morning flight to bear this timing in mind- if there are no problems then usually the passport with visa gets back to you around 3:30 /4:00 in the afternoon. (With Hana Express- I haven't used any other agent there).
So a flight back out needs to be 8 or 9 pm otherwise you will be racing around like a headless chicken.

I used to fly in from bandung & the early morning flight wasn't early enough- so I had to get in the night before & stay in a hotel & the late flight wasn't late enough so I had to stay in a hotel another night once I had my visa.

& don't forget there is a 1 hour time difference singapore is 1 hour ahead of Java.

If it hadn't been for forum members helping me years ago (& still now) I would have had a hell of a time sorting through things. I fully believe it is nice to learn things and pay it on & help others.
 
If you are going to exit out to KL or Singapore and come back, I would pick up your EPO and passport, but not accept their ticket. Even if you can get it to stop in Singapore and you just get off there (carry-on luggage only!) I think you lose some leverage in accepting their ticket.

I dont see how. It would create a problem in that warning them of what you are doing. As Atlantis said the company needs you to do your EPO properly.

As an aside, i also live in Bekasi and there are only a few schools that employ expats. I wondering which is yours. (But don't name and shame yet...just thinking aloud).

It is not at all improper to use your own ticket for EPO, you simply must leave the country. If a court decides he is owed some severance pay or other compensation, the school may argue that the ticket price should be deducted from the amount owed. He could respond that he did not accept the ticket because they did not give him any choice in the timing or destination, and therefore he should get the full amount. Just one possible way I imagine it could play out. Regardless, there are some risks with disembarking at a layover stop.
 
Thank you all for the further feedback. Will', they are right on the border of Jkt and Bekasi, Kali Lantar river to be exact and can be seen behind/near the McD's from the tol or Jl Hankam/Kranggen. That should pinpoint them pretty well. Gempol is a km away, to the south.

Today and yesterday are more frustration. The school came yesterday and did deliver some portion of my salary for December (the remainder to be sent next week to my bank, hmmm), along with my EPO'd passport which I must depart from Indonesia with today, however the ticket they brought for me (placed an itinerary in my hand) could not be shown/seen online with the confirmation number. We tried for 15 mins on my laptop, that I brought outside to the porch. We gave up, trying all the combinations we could think up, but the booking did not show up. They said they would fix it once they went back to the office. That was yesterday and they did not contact me again about a ticket out. They have said that they have purchased another ticket and that Imigrasi would deliver it to me. Imigrasi contacted my secretary (a lovely jilbab'd angel friend of mine for 15 years) and said to her that I had somehow made the ticket disappear and that I should "be cooperative" and fly out. I was fine with that and planned to get off in Seoul and fly back with my own ticket on VietJet, however there isn't a ticket out. We tried contacting the school again, but no ticket was given. Call to Imigrasi again and now there isn't an answer. This was all yesterday. The itinerary showed the flight out last night at 10pm, Jan 4th.

Nothing further from the school or Imigrasi this morning. I am thinking to go to Imigrasi now, because today before midnight is my last day on the EPO marked date, and then Overstays (300rb/day) incurred. It may be better if I could speak with a higher up there. Pak Sutrisno (sp?) is the head and his signature on the epo. Mr Heri is the young man who came to the house before and the next day interrogated me and took my passport. He can not be reached also.

I think I have complied with all regulations and stated my case with Imigrasi. There not being a ticket out is my concern and so I think I need to get myself over to Imigrasi and speak up, nicely of course.

Monday is the first mediation date at Disnaker Jkt-Gambir, next door to the US Embassy. I imagine the school will be a no show, but remain hopeful. I don't know what the rules are for the mediation and what a no-show represents or what time limits are set for inaction from the school/company before it continues on to the Industrial Court.

So, now I'll look to plead my EPO ticket out case at Imigrasi Bekasi. The higher up may be my best person to do this with. I'll have to do some searching now to see who that might be, but at least I'll start with Pak Sutrisno there today.

More as it occurs.

Monday eve I'll post on the first mediation and what it entailed.

Called Imigrasi again before heading out and younger guy answered. Boy, he sure did sound like he was recovering from a heavy bout of bottle-itis. First day the office was open again this year apparently.

He said he knows I must leave and would contact the school to confirm they have a plan to get me out tonight.

Two hours later and no word, but another call to Imigrasi and he says that the school will get me out tmrw and I will have to pay one day of Overstay.

Tried to confirm this with the school admin and they only replied that they saw me out shopping at Giant with my secretary "dating" at the time I should have been checking in, they said, and that I did not go to the airport myself to check in. I replied that there wasn't a reservation visible or existing, and how could I possibly leave then. I had someone at the airport check for my ticket out also and the airline agent could not confirm a flight out as well.

So, I think this has been covered enough and will await for a way out tmrw. Maybe there is a spy watching the house still too. The residence satpams no doubt are complicit. The commander said four days ago himself (when I showed him the broken side door of the house the school had smashed open, lock is disintegrated) that he would give me a copy of the cctv video (pointed directly at my house), but still has not given. I told him that two of his own satpams escorted the school SUV and just sat on their motorcycles for an hour as the monkey terrorists went to work. Perhaps the commander is afraid if I have a copy of such horrid examples of his staff's security detail. More on this later. It will be interesting to see what excuse is presented by the commander, an older ex-military Sgt Rock type. All of the satpam recruits apparently are ex-military, my secretary found out.

Hopefully tmrw I will have successfully left and begun return back for Monday's Disnaker date.
 
Did you get a picture or the name of the person at the airport? That might help you at the mediation.
 
I would personally exit Indonesia on my own cost to Singapore and then come back with all proper stamps/visas in the passport. In Indonesia people are always late they have time for everything I wouldn't rely solely on them (school HR, Imigrasi you name it). Also what ever they say you should take it with a pinch of salt. The whole situation that you have described looks like a good ping-pong game between all third-parties being involved with you standing in the middle of it.

I have read some of your posts (I hope I've understood them properly): .... it looked to me like someone tried to contacted with you ... yes those people shouting outside like monkeys. Could it be that they were sent from school to deliver your passport? If yes (and they were assisted by SATPAM) they should prove they did everything to deliver documents to you ASAP.

As for the close connections between school with Imigrasi and issuing EPO..... I am not even a tiny bit surprised. They have "given" to Imigration a fair amount of money either by bribes -read necessary fees or agents fees by employing foreigners. The Imigration will stick to its "customer requirements". This should also show you how things are in Indonesia. My guess is that the school also have some legal representative - a friend and healthy budget.

Exiting Indonesia should not null your legal dispute and it should be still in motion. The same as if the case will land in the employment court. You just have to come when you are summoned.... but you can always change the date.

I am not sure if I should ask this but this 300 jt. is it because they haven't paid you your last salary for x months or simply the flight ticket or both?

About the house.... is the house rented on your name or the school is providing it, do you have contract on your name or school name? Again SATPAM were probably informed about your case and they wanted to monitor what is going on, maybe the school staff asked for their assistance if you would go rampage .... maybe they wanted to evict you since your contract was terminated? Not sure. Maybe they tried to contact you to get the keys (since they don't have spare one), maybe you forgot to give it to them or didn't want to talk to them, maybe they though you forgot to return the keys...... as you can see too many maybes here. But some of them make some sense (at least to me).
 
Hi. Still nothing on the exit out ticket. Today is day one of Overstay. I'll try calling Imigrasi after Jumat prayer and see what is happening there. Probably need to go in and nicely demand another week extension on the exit out, if that's possible. The school has not delivered ticket out though. I'm sure the company greases Imigrasi in some way. I was asked to come to the school and begin work within one week from interview. They said not to worry about any 'Imperial entaglements' with govt and I would be fine until the kittas came, about 3 weeks later, after arrival back in Indo'.

We have the airline's agent name at counter. It could not be checked online also (reservation did not exist), on several computers and different IP's. The company has not provided a ticket out. They had a complete itinerary and I did check it and could even choose my seats, about a week ago, but all this week I could not, days before and up to the last hour before departure. Maybe the company just wanted to print up an itinerary to show Imigrasi and then they cancelled it.

Last night I received a request by the airline (the one the company said I had a ticket with, via phone call from Altanta) to change my password, they said they were concerned that someone was trying to access my account, so I logged in from the email airlines sent me and changed it. The house is contracted to myself. There was a stipend given at beginning and I also added to that, however it is all in my name.

Secretary's lawyer friends were contacted. The three spoken with all said to sit back and take it easy. They also said that I would probably not need them and all the pressure would be on the company. Odd to not have lawyers offering their services.

OK then let's sit back and enjoy the ride. It would be nice if you could keep us updated on this situation. It would help other English teachers working here to understand what is allowed and what is not when it comes to employment.

Looking at email this saturday morning and found this in old uni Sydney email box, from Wednesday, with an attached image of a ticket reservation from the airlines website, but I had someone check then too and this reservation did not exist. I think the company just created a ticket and then refunded it shortly after.

Imigrasi Bekasi,
You have sent a ticket that is three days late. I never check this email. You know my telephone number and you know **secretary's** telephone number too and I have spoken with you many times in the last few days and you have my WhatsApp also.

Why do you not say that there was this ticket?
You are Indonesia and you are liar. In my country government people have honor. You do not. Military fights with strength and honor, but not you. Tricks, lies and laziness you give.

This ticket would not be accepted in any court, because this is not my main email.
You lie. You are agent school. You are liar. Sleep well sir, sleep well with your lie. How much did Pt Yayasan Dian pay you?
What a fine gentleman you are. You make your country low. No honor.

I spoke with the head probably six times in the last few days. He never said a word about this ticket. Yesterday he even said he would drive me to the airport himself and I said, 'With what ticket?'. He said, "...wait and I will call you back, Mr Toni from the Pt Yayasan of your company school is calling me now". He has never called me back once after he said he would, including this time as well. I am not playing his game correctly, it seems.
 
Careful with insults and accusations no matter the level. They are still in control and if you get deported and blacklisted you won't have any time when you get back because you won't be coming back.
