Have any teachers managed to get KITAP?

Hi everyone,

I've joined the forum because I have been an SMA teacher for 4 years on a KITAS (sekolah nasional bukan satuan pendidikan kerja sama / internasional). Eventually, I would like to become WNI.

However, the advice from agents is that it's unlikely I will be able to apply for a KITAP because I'm only in a teacher position. Usually a KITAP would be for those in higher positions in their organisations.

Has anyone been in this position, or does anyone have any advice?

Problem is things have changed a lot many times very recently even this year several times
 
I’m not a teacher and someone in that position will tell me if I’m wrong, but I heard from WNA and agents the same thing:

Only people who are in executive functions, retirees, ex WNI and people married to Indonesian citizens, can get an ITAP.

Obviously after some (3 for most cases) years on an ITAS.

I know well about Immigration's Regulation but just a little about Work Regulation .
In relation to Immigration , it is possible to get a Work KITAP (see the rule below) .

In relation to the Government's Manpower Department , I don't know if your employer can get its ok for giving you a 5 years work contract .

I suggest you to first ask your employer if he/she can offer you the 5 years work contract & sponsor you for the 5 years Work KITAP . If he/she agrees , you or an agent can later ask the Manpower Department (maybe through https://tka-online.kemnaker.go.id/default.asp) .

An easier way is to marry an Indonesian .
The agent said unlikely, but if I'd like, they'll try to apply on my behalf.
An agent can only apply on your behalf when you don't need a sponsor , for example for an investor Visa/KITAS/KITAP .

In your present situation (with Work KITAS) , the agent (if there is one) is/will be applying for Immigration processes on behalf of your employer .

I don't see komodosambal saying he is Australian. If he is and is looking to give up Australian citizenship this would seem a very unwise decision. At any stage in life I have always asked what is my fall back if things go spare. Long term there is losing pension and Medicare entitlements and easy access for medical or other reasons to return. One hopes that Indonesia weathers the uncertain economic problems created with the Middle East crisis but it is possible that things could turn ugly down the track. Indonesia does not allow dual citizenship so I find it hard to see advantages in becoming an Indonesian citizen.

Especially since the KITAP is such a good option

For employees with a work permit, only president directors can get KITAP.
 
This is the feedback I also got from my agent - I'm a regular director and I cant get it. Next time we update the deeds I'll try change to president director to get it.
Written in the current regulations.

As I said in post no.6 , I was not aware of the Work Regulation , but as you said the above and didn't provide the 'regulations' , I searched and found the one in post no.14 .

So to make my position clearer (please also see posts no.6 & 14) , I see the OP's case depending on 3 participants :

1. The OP's employer/sponsor/guarantor : the one who will decide about : OP's new work contract, submitting the RPTKA extension, and requesting the KITAP ;

2. The Manpower Department : that may approve the RPTKA extension and recommend the KITAP issuance to Immigration .

3. The Immigration Department : that may issue the KITAP.

However, your Notary may not be able to change to president director if your company only has one director. You can only be president director if your company has at least 2 directors.

The regulation uses the term "pengurus tertinggi", so if there is no board of directors but only one, the sole director is eligible for ITAP.

That means gemina should have gotten her ITAP.
