Hi Guys, My Elderly Aunts husband has passed away after a fight with cancer that lasted five years. They own a Condo within a complex of about ten other condos, and my Aunt now wants to sell it.
Here's where it gets complicated..,
The complex was built and run by a friend of my Aunt's late husband, but apparently, since My Aunt has been in Australia for so long caring for her late husband before his passing, the complex (management) has apparently changed hands to a different company or whoever.
When my Aunt's husband became ill with cancer, they ceased going to Bali after that. So while they were back in Australia, my Aunt and her husband had left the villa in the hands of the husband's complex's / manager/owner friend to 'rent out their condo or to find a buyer for the condo' ....,
The verbal agreement they made with their condo management/ complex owner 'friend' .., was that any rent/income deriving from my Aunts condo would pay the monthly contribution fee (i.e. the running cost, management, shared maintenance ) ( I'm not sure what the name is they call that in Indonesia. Its called strata fees in Australia), and any money earnt from the condo above the monthly fees, they would be paid ..., needless to say, they never saw a cent from the complex management, nor was there ever a buyer found...,
Except for one who paid a hefty deposit to the complex owner.
Still, those buyers never managed to finalise their contractual obligation to pay the remainder of the balance by the due date or at any date thereafter, so they failed to become the new owners of my aunt's condo, and the title, therefore, remains in her name.
During their time in Australia, they never heard a thing from the 'so-called' friend/condo management.
He disappeared off the radar completely and never once answered their phone calls or replied to their emails.
Apparently (the word through the grapevine), he has 'run away' and left Indonesia altogether (note: he was a foreigner but had gained Indonesian citizenship). Anyhow, he is gone, as far as my aunt knows.
He is not important now, as the ownership/management of the villa has changed hands as far as she knows, but my Aunt still has the title for the villa and wants to sell it. She has no idea what's become of the villa (if it's being rented out or what, or if money for maintenance is owed, and if so, to whom) after being shafted by the husband's 'so-called' friend.
As she is too stressed (and old ) to deal with it, I am going to Bali soon, and while I am there (on behalf of my Auntie), I want to find out who is now running the show regarding the condo complex.
Question: What legalities do I need to investigate, and what avenues should I pursue to get answers on behalf of my Aunt?
Before I go to the complex or even consider talking to a notary or lawyer, does anyone have any advice or knowledge to share from those who have had to do something similar?
cheers.
