Returning to Indonesia with a Foreign Passport

Did you read the previous post which I have amended as I found the post that I wrote previously and I have included the citation from the regulation. If you still think it does not answer your question then I leave it to you to have your own interpretation.

PP_No_2_2007 : Government Regulation On PROCEDURES For Obtaining, Losing, Cancelling, And Regaining Citizenship Of The Republic Of Indonesia.
Article 31 para 2
"Indonesian citizens SHALL BE DECLARED to loose their citizenship by the President on the basis of their application in the case of the relevant already turning eighteen or marrying, being domiciled abroad and declared to loose citizenship of the Republic of Indonesia not to become stateless."

Also it is reiterated in article 38:
(l) The President shall stipulate decree on loss of citizenship of the Republic of Indonesia.
(2) Text of the presidential decree as meant in paragraph (1) shall be conveyed to Representatives of the Republic of Indonesia ln not later than 14 (fourteen) days as from the date of stipulation of the presidential decree and copy shall be made available to the Minister and Representatives of the Republic of Indonesia.
(3) Representatives of the Republic of Indonesia shall convey the decree as meant in paragraph (2) to applicant in not later that 7 (seven) days as from the date of receipt of the presidential decree.

I confess that I didn't read the part you talk about the Regulation , this because I asked about the Law (which is more relevant) .

But as you insist to argue referring to this Regulation , ok , lets do it :

As far as I understand (but I am not a lawyer) from the Regulation below (that you referred) there are 2 ways to lose the Indonesian citizenship : by the person's own decision (automatic , does not depend on the Indonesian President) , or by request to the Indonesian President .

So , it seems to me that you misunderstood the Regulation when you said (in your post nos.11 & 21) : "... It's important to remember that only the President of Indonesia has the authority to officially declare someone has lost their Indonesian citizenship, no one else. So unless you have formally renounced your Indonesian citizenship and declared by the president, it is still a grey area whether you have lost your Indonesian citizen ..." .

Article 31
(1) An Indonesian citizen automatically loses his or her citizenship due to:
a. acquiring another citizenship of his or her own free will;
.....
g. holding a passport or a document representing a passport from a foreign country or a document that can be interpreted as valid citizenship from another country in his or her name; or
...
(2) Indonesian citizens shall be declared to have lost their citizenship by the President upon their own request if the person concerned is 18 years of age or is married, resides abroad, and by being declared to have lost their citizenship of the Republic of Indonesia, they do not become stateless.

Article 35
(1) An application for loss of citizenship as referred to in Article 31 paragraph (2) is submitted in writing by the person concerned to the President through the Minister.

(1) The President shall issue a decision regarding the loss of Indonesian citizenship.

Poster's Note : Although Article 38 does not clearly state , to me it makes sense to think that it refers to the case where the person request the citizenship loss to the President , as Articles 35, 36, and 37 clearly state to relate to this case .
