Villa Ownership problem in Ubud, Bali
German Citizen, owner of Villa in "Russian Village" in Bali Becomes Suspect, This is His Mode

The reason for detention, he converted a food crop subzone into a villa with a spa and an animal farm was due to a lack of proper permits.

There is no clear explanation of how his company managed to construct the villa without a permit. It seems unlikely that building authorities, during their patrols, would fail to notice the ongoing construction. It’s hard to believe he would recklessly build the villa without any permits. He may have secured some form of authorization before proceeding with the construction.

Usually the contractor is responsible for obtaining the building permit, if permit was issued, then investigate the government official who issued it. The German investor was a victim, those who cheated him should be arrested instead.

Anyway, do you think the villa is going to be demolished and turned back to its original state? If not, who will be owning it later? How did the new owner acquire it?

Perhaps when permits were being sought there were some local officials who were not invited to put their noses in the trough. I suspect that given the size of the project, monies and personnel involved there will be some sweeteners for those who missed out and then it will be business as usual.

If there is no permit, then the German investor was cheated by the contractor. The contractor should not start construction without any permit. As a foreigner, the German investor, may not be aware of what permits are required. He should hire a good lawyer, like Hotman Paris Hutapea.

All of this doesn't make sense. How were the investors able to get so far into the project without permits? Someone obviously was collecting a lot of money for the land, roads, building material, workers, etc, and how could they even start such huge projects, without permission? I say someone along the line didn't get a chunk of the money and got pissed off and ratted to the authorities! Are they going to bust the Indonesian people that initially got payed? Or just the Germans?
And what about the Russians? Aren't they behind this huge project too?
This reeks of corruption at it's finest!

Well obviously from the video, a lot got constructed. This must have taken years to get to that point. Where were the Police from the start?
Maybe the authorities let all of this be constructed, so now it's finished, they can come in, seize it, and get all that work done for free? Is this possible?

This case has recently attracted many main media attention, so they must proceed cautiously, as their actions are now under public scrutiny. Compared to large-scale corruption and major disputes, this case is relatively minor. In the past, even the Supreme Court personnels, the ultimate arbiter of justice, could sometimes be influenced through bribery to sway decisions

Not to my experience, recently - at different scale, early 2024 we talked to 4 contractors for the construction of our hut. All of them excluded all building permits - their SOW are limited to building construction only. One of them, in their website stated include permits, referred us other company to handle the permits.
Finally, we take care all the permits ourself, followed all the procedures, clean process - no major issues.

Cant say about parq, but years back hundreds illegal (No IMB) building was demolished in Puncak, Bogor.

The building was built on rice field (green area), so even theoretically could not obtain a building permit, before or after.

In Gyanyar you could still reclassify the rice fields to building land until recently I think. Some kabupatens prohibit this practice (i.e. Denpasar).

This is something that you need to double check in addition to check the kabupaten/province master plan, which was developed and approved by governor / provincial level. However, there is additional protection in the framework of national food security regulated by the ATR/BPN ministry, namely the LSD (Lahan Sawah Dilindungi - Protected Rice Fields) status - not many people aware, even our lawyer when we'd like to build our hut. Changes in land status can only be done from Jakarta, and are basically very limited, and not easy for commercial buildings. Currently it is even more difficult especially in Bali.

Sadly, many building was built without proper permit; and assuming the permits can be done later on.
 
This is yet another example of a foreigner spreading misinformation about land ownership while flaunting their lifestyle in Bali to scam people. However, it is good to know that he has now been banned from re-entering Indonesia. He self proclaim to own a lot of villas in Bali. Now he has been deported What will happen with his villa investment then (If any) ???

It is clear to me that this person is an investment scammer. Wealthy individuals, such as hedge fund managers and billionaires, usually don’t flaunt their lifestyle like that. However, many naive millennials and Gen_Zs fall for things like this, which is why they are often the primary targets of investment scammers. But there are a lot of investment scammer like this on YTs, but now some of them have moved their target on properties, villas in Bali.

In the past there are Indonesian investment, trading, NFTs, crypto, scammers most of them are already behind bar.

This was soooo satisfying. Thank you for posting it. I missed this story.

He keeps complaining other youtubers (other scammers) said they purchased land too. He admits at various points he exaggerated what he spent and his business interests "to feature Bali". I doubt he spent much if anything on these. I don't know how much of this was to scam investors or just clicks. I am betting it was more fake it until you make it, flaunting perceived wealth for views to try to get attention. Well, he got it. Negative attention.

From a different article of the Indonesian government: "Investors will think twice about investing in Indonesia if a lot of inaccurate information is spread." Great to point to when every other scammer comes in about buying land in Indonesia.

The youtuber said something interesting. He mentions that the seller listed the sale as far below the purchase price to save on taxes. While I can see it saving the seller on income taxes, wouldn't the hak pakai buyer pay the transfer taxes? I thought hak pakai agreements had a lot of other hurdles to jump through for foreign buyers, (new construction, minimum size, purchase price, and full house, not bare land) Does anyone think he did not have a valid hak pakai and just a hak sewa?

Last I checked, restaurants were still on the negative investment list and must be majority owned by an Indonesian. Some can update me if that is no longer the case. If he is banned from the country and actually had an ownership interest in a restaurant, he will have a hard time making any claims to profits or oversite after being banned from the country. "This restaurant makes millions of dollars per year." I am sure the tax department was happy to hear that. I imagine even if he did have ownership interest, his partners threw him under the bus for that one. Probably will claim not AUD, but LRD (Liberian dollars).

Also possible he has another YouTube channel for different purposes where he could direct people form one channel to another channel. He earns money through YouTube's advertising revenue sharing. While he claims to own several villas in Bali, I seriously doubt he owns even one.

Some content creators like him also boost their income by selling overpriced or useless investment/trading courses. Additionally, some resort to scamming others with fraudulent investment schemes.

Anyone just with little knowledge from investing or trading can spot these scams from a mile away. Millennials, Gen-Z susceptible to falling for such schemes are better off avoiding investing or trading altogether. Also just be aware about comments on YTs on each video. The comment are sometimes created by bots or another scammers, their friends to bait people .

After coming to Bali for over 35 years, I have been offered multiple times by so called friends to help me buy Land. I always laughed and said thanks but no thanks. They were so obvious making this offer, they were only thinking how they would end up with a house for free, that I built, they would still own the land, not me.
Oh and they would do this with a smile on their face, and speak with a silver tongue! ( Such Good Friends)
Land speculation is a dangerous game to play. It's like gambling. Some win, but most lose!
