Our Son is a dual national 17 year old. I have just been told by an agent that if he gets an Indonesian KTP, for processing a SIM etc, that he will forfeit his right to dual nationality as this implies that he has made the choice by applying for the KTP.

As I know, he has until age 21 to make the choice and I have never heard that a KTP would enter into the equation.

Any first hand knowledge out there?

Cheers,

That’s an interesting question as foreigners KTP is a differen colour to Indonesians, sorry I cannot help though

Follow up here...no drama. Not a problem and no affect of status. Whew!!

Yes, the UU 23/2006 only states that a KTP is mandatory at 17, no mentioning of citizenship anywhere. So yet another BS-ing agent...

Pasal 63

This is another b******t said by an agent. I know a few kids (three for sure) who are dual citizen and KTP holders. Saying this sort of crap is the same that saying that s/he can not have a passport RI which requires to be WNI to be issued.

Dual citizen are Indonesian AND hold another citizenship. They are not half citizen, or people who may be citizen when they will reach the age of 21 and make their decision on which SOLE citizenship they want to retain.

Jaysus Krist! this level of stupidity by an agent in an answer to your question infuriates me. Ask him to point at you in the UU tentang administrasi kependudukan and UU tentang kewarganegaraan where he has been reading the crap s/he peddles. The Constitution RI clearly stipulates that no WNI should be treated differently one to another. Dual Citizen are WNI and therefore have a right to get a damn KTP at age 17.

To be fair, the agent did get back to us and corrected his statement. He did some more research and found that he was wrong and apologized.

It is fair of you to say it but it doesn't mitigate the fact that s//he is anyything but professional. In my world, when it comes to business, you first research then talk rather than the reverse.
And honestly, it isn't a complicate matter. It's not like anything pertaining to land law, manpower law or company law where things may be a tad more complicate and crosscheck of other Law may be needed. It's about citizenship, a very basic law. The fact that s/he can't realize that all Indonesian citizen are equal before law is appalling and would make me put a mile between him/her and my documents.
