I would like to inform readers of this forum about something, where I think most applicants will go in the same "trap" and will loose quite some money. The talk is about Pemenkumham No.22 tahun 2023 Pasal 79(2) which says “The application for an extension of the Stay Permit must be submitted while the foreign national is within the territory of Indonesia”. Additionally the "Surat Edaran Direktorat Jenderal Imigrasi Nr. IMI-417.GR.01.01" was issued in May 2025 introducing the necessity for a domicile letter (SKTT). The problem is that now the Immigration office does cancel each online application (evisa.immigrasi.go.id) for an extension of an ITAS E31a (as well as other similar online-applications) if the foreign national is not in the territory of Indonesia from the time of online-application until photo-taking in the immigration office. At any case you loose your already paid application fees (7000000 IDR for prolonging an ITAS E31a), but it can even go much worse.



My story goes like this:

Just three weeks before the expiry date (11.7.26) of my ITAS E31a the function for application of an extension became active in the online-page. On 22.6. my Indonesian wife (sponsor) applied from my home country online for extension. She filled in the form and uploaded three requested documents. Nowhere any info was given that the sponsor would just be allowed to do so when being in the territory of Indonesia. After succesful submission of the application a paying reference for 7000000 IDR was visible. Since as per web-page the application would only be processed after payment my wife immediately transferred the money.

One day later my wife got an e-mail from the immigration office telling that the application has been postponed since further documents are needed. She should merge all missing documents and send them from the online-page used for the original application. One of the requested documents was an Indonesian domicile letter (SKTT) for me. In order to get this we contacted the Residents' Registration Office in Bandung, where we got as the first possible appointment date 15.7.26 (which is 4 days after expiry of my old ITAS). My wife uploaded all other requested documents and added a letter telling that the SKTT-appointment just will happen on 15.7., so that the SKTT can not be provided earlier. After this the status of the application was visible in the online system as "Waiting Officer Confirmation".

I then asked ChatGPT whether I will have to pay overstay-fee (1000000 IDR/day) if I enter Indonesia with my still valid ITAS and the application for extension just will be finished after expiry of my old ITAS. ChatGPT replied: "The Indonesian immigration authorities explicitly clarify that an ITAS extension applied for and paid for on time does not constitute an overstay if processing extends beyond the expiration date".

With this information from ChatGPT my wife and I entered Indonesia on the last day of validity of my old ITAS E31a on 11.7.26. We then went on 15.7. to the Resident's Registration Office in Bandung and applied for my domicile letter SKTT. They copied my old ITAS and told me that I will receive the SKTT just five to seven days later by e-mail.

On Friday afternoon 17.7. my wife got a call from the immigration office to come on Monday 20.7., which we then did. Until this day the status of the application had not changed (Waiting Officer Confirmation). To our very negative surprise the immigration officer told us that the application for extension of the ITAS E31a has been rejected. The reason in the online system was given as "Permohonan dibatalkan dikarenakan Ybs berada di luar negeri, sesuai Permenkumham RI No 22 tahun 2023 Pasal 79 ayat (2)", which translates as

"The application was cancelled because the person concerned was abroad, in accordance with the Indonesian Minister of Law and Human Rights Regulation No. 22 of 2023 Article 79 paragraph (2)".

The immigration officer told as that both the foreign person as well as the sponsor need always to be on Indonesian territory from the moment of online application until the taking of the photo after approval of the application. Since we entered Indonesia just on 11th of July and the online application was already submitted in June we did not follow the existing regulation, so that the application is being cancelled. Interestingly I also had to fill in a form, stating that I want to withdraw the application myself. I had to sign this form on a just bought stamp of 10000 IDR.

As a further consequence the immigration officer told me that I will have to pay an overstay fee of 9000000 IDR for the nine days since expiry of my old ITAS. I objected that the application was just cancelled today, but the immigration officer meant that their electronic system is like this and he cannot change it. At first he also meant that I now will have to leave Indonesia, otherwise I may be deported.

My wife asked whether there could be another solution. After some discussion someone suggested to open the online-application page and to check whether a new application for extension of the ITAS E31a could be made. With the credentials of my wife the immigration officer checked this possibility in the online-system and indeed this was possible. Before uploading all documents again, I was handed out an invoice over 16000000 IDR (7000000 IDR fee for new application of ITAS & multiple re-entry, 9000000 IDR overstay fee), which I immediately paid online.

After this we uploaded all necessary documents again, except the not yet available SKTT-letter, where the immigration officer meant this could be tolerated. Then my photo was taken and it was said that I should receive the new ITAS E31a next week by e-mail. To my surprise my wife got on the same day a WA-message from the Residents' Registration Office telling that the SKTT cannot be prepared, since it needs a valid ITAS. So this meant that after expiry of my old ITAS on 12.7. in combination with the given appointment date on 15.7. I never could get an SKTT letter due to missing a valid ITAS and vice-versa I never could get a new ITAS due to missing SKTT-letter.

As a final remark another KI-software (Kimi K3) meant about this case:

"This case suggests systemic regulatory extraction – where immigration rules are designed to create unavoidable delays and mandatory duplicate payments, effectively functioning as a fiscal mechanism rather than a regulatory one".

First: How could one know about this rule, which is hidden somewhere in the regulations (which nobody will really read in full length and detail), if there is absolutely no mentioning on it in the online application system?
Second: Even if we would have been all time in Indonesia the three weeks period in which you can apply for extension of the ITAS would not have been enough time to apply for the needed SKTT-letter before the old KITAS is expired. As mentioned, they gave us the earliest possible date for the SKTT appointment, which was 4 days after expiry of the old KITAS. And this means that the SKTT letter could not have been issued due to missing valid ITAS. Then the ITAS application would have been cancelled by the immigration officer due to missing SKTT-letter and for us it would just have been a different reason for cancellation, but the result would have been the same. In a nutshell: you can be fully willed to follow all rules and regulations, but still you would end up in the same negative result.

Bureaucracy, the gift that keeps on giving...on a good day...like the day after Hell freezes over. I am sorry to hear your story, thanks for posting. I am reminded of the old adage "if it can go wrong? It will go wrong." As unpleasant and traumatic as this has been, perhaps there are others who will learn from it. Wherever you go, there you are. Time is of the essence. It is always a good idea to keep ahead of the administrative bureaucratic ball.

So you admit you entered a country without know the laws regarding visa and immigration. You left it to the last minute and then asked 2 AI chatgp websites for advice.

Fact if you had applied when you should have you would not have overstayed because the date you submit your application and it's received in their system you are fine. If you can't provide the information they ask that's on you Sir.

And yes it clearly states if you leave the country you forfeit the application

Ironic why it's called common sense when clearly etc etc

Here legally? Until when? Do you need us to double check you read the date on your visa correctly or asking advice how and what to do next?

While it is a positive that efforts are being made to bring online access to Immigration matters, it is still very much a work in progress. I would be very cautious about trusting ChatGPT for legal matters of such profound personal and fiscal consequence.

There are still lots of pages which have not yet been translated to English.
Hopefully, eventually when completed, it will be more comprehensive and user friendly for English speakers.
 
@BliGundul , I totalize 31 years in various Asian countries, of which 8 in Bali.
One thing I learned is to follow STRICTLY all the rules.
Never try to put the blame on others as you do.
And NEVER FORGET YOU ARE THE IMMIGRANT !
They can kick you out on a wimp for whatever reason.

I started the process to go from 5 year pensioner KITAP, to permanent KITAP.
I will open a tread on it.
Pensioner visa, not married....I am too young for that 😁😁🤣🤣
 
It seems everywhere one of the major functions of immigration departments is to make the processes complicated, confusing and increasingly expensive. Australia has just made a big leap in visa costs across a wide spectrum. Over the years I have had quite a lot to do with Australia's immigration systems and came to what I think is a quite reasonable conclusion. The department is deliberately understaffed and underfunded to creat a bottle neck meant to discourage all applications for visas other than those that conform in a very straightforward way for tourism and those with skill much needed or those with plenty of money to invest.

I quickly read it but didn't find this issue there .

From my files , in the past (until 2020) Immigration was requiring a domicile certificate/surat keterangan domisili , then in PP no.50 Year 2020 this document stopped being required but in practice it continued to be required , recently the SKTT started to be requested in its place or as an alternative .

Important to say that you probably could comply with a 'Surat Domisili' (from going to Pak/Ibu RT & RW + Kantor Kelurahan) , instead of the Registry Office's SKTT . I myself did this many times , only around 4 years ago I started using the SKTT (as I already had it) .

I would argue about that . From the Government Regulation (see below), that is not a reason strong enough to cancel you application , in my view .

"Applications for granting, extending, changing status, and changing data on a Stay Permit must be submitted while the foreigner is in Indonesian ." (Article 79 of PerMen 22 Year 2023 - free translation)

By the way , I can't understand the need for such a rule .

And I disagree with you .

My logic : Online process normally is to be done from anywhere . In this case the process is not fully online because you still need to go to Kantor Imigrasi for photo/fingerprint/interview , but this can be done near the end of the process , weeks after the start (in my recent process the system asked me to go there just after the payment , but when I asked why , the officer told me to forget the request , and they asked me to go there again only at the end , which makes more sense to me) .

Even me , who know most of the Immigration Laws & Regulations didn't know that specific (new) rule .
And yes it clearly states if you leave the country you forfeit the application
Could you show us where the rule (or similar) states that the application will be cancelled if the foreigner is not in Indonesia ?

I agree with you .

Now I disagree . By Law you should get the SKTT as soon as you get a new ITAS (although in practice usually there is no penalty for non-compliance) .

And as I said in post no.11 , Immigration would probably accept a 'Surat Domisili' insteady (which I used to get in just 2 days) .

Once again I disagree , regarding Indonesia . But about that specific rule I agree that it may complicate .

By the way (about you finding the online process complicated & confusing) , from the document that OP showed us , you are probably eligible to do Immigration processes face-to-face (see below) .

So you didn’t (want to) know you needed a SKTT. Nor that practically all Catatan Sipil have a walk-in process and don’t require appointments, and esp. in emergencies nobody would send you away. Nor that in places like Jakarta it can be done online? Well…ChatGPT could have told you.

I don't blame him for that , as the SKTT (although being required by Law) is an useless & unknown document for most of the KITAS holders . I guess many ITAS holders never got it in the past up to around 4 years ago (when Immigration started to put it in its list of required documents , although not stated in Immigration Law or Regulations as far as I know) .

I had to make an appointment in my city .

This bit is correct it is exactly what is stated in Pemenkumham_No_22_2023 article79 Para (2)

"(2) Permohonan pemberian, perpanjangan, alih status, dan perubahan data Izin Tinggal diajukan saat Orang Asing berada di dalam Wilayah Indonesia."

An extension of an E31A ITAS (spouse of an Indonesian citizen) is an onshore process. The applicant must already be in Indonesia with a valid ITAS when submitting the extension application.

In practice, Immigration generally expects the applicant to remain available because biometric enrolment and/or an interview may be required before the application can be approved. However, I have not found any current law or regulation that expressly states an E31A ITAS cannot be extended if the holder is abroad after the application has been lodged.

Likewise, I have not found any provision stating this 'if you leave the country you forfeit the application which in this op context it will automatically causes a pending E31A extension application to be cancelled or forfeited. Those who said that in this thread mind to provide the authoritative source, such as relevant article from the law or regulation, or an official statement or guidance issued by the Indonesian Immigration? So we could all learn.

I think this may be the mistake you and your spouse are making.

Also, if I remember correctly, the sponsor is generally expected to be in Indonesia when acting as a sponsor. In your case, your sponsor submitted the application while she was still overseas. Moreover, both you and your spouse were still abroad when applying for the extension. However, I have come across cases where E31A applications were approved even though the Indonesian spouse was outside Indonesia at the time. So, this requirement may not be strictly enforced in practice.

Also another thing here is your SKTT which is required according to the law. The legal basis is not Immigration law itself but Dukcapil

This bit is also correct. As long as you have paid the immigration fee before your ITAS expires, an overstay penalty should not be imposed. This is explicitly stated in Permenkumham_No_22_2023, Article 116 para (2):

"Permohonan perpanjangan Izin Tinggal Terbatas sebagaimana dimaksud pada ayat (1) yang telah diajukan dan dilakukan pembayaran biaya imigrasi sebelum Izin Tinggal Terbatas berakhir, tidak diperhitungkan sebagai overstay apabila penyelesaian permohonan melewati jangka waktu Izin Tinggal Terbatasnya."

So, if the extension application has been submitted and the immigration fee has been paid before the ITAS expires, any delay in completing the application beyond the ITAS expiry date should not be considered an overstay no overstay fee.

In your case, the situation appears even stronger, based on my understanding. You still had a valid ITAS when you returned to Indonesia. If that is correct, Immigration could have simply asked you to complete any remaining requirements, such as biometrics or an interview, after your return to Indonesia while your ITAS was still valid.

The concern is that the application appears to have been unilaterally cancelled while you were absent, and you were then required to pay an overstay fee. 😁 😁 😁

Given the various corruption cases that have emerged in Indonesia, I can understand why some people may question whether such discretionary actions are being used improperly. However, the key issue is whether Immigration can provide a clear legal basis and official explanation for the cancellation and the overstay charge.

Second: Even if we would have been all time in Indonesia the three weeks period in which you can apply for extension of the ITAS would not have been enough time to apply for the needed SKTT-letter before the old KITAS is expired. As mentioned, they gave us the earliest possible date for the SKTT appointment, which was 4 days after expiry of the old KITAS. And this means that the SKTT letter could not have been issued due to missing valid ITAS. Then the ITAS application would have been cancelled by the immigration officer due to missing SKTT-letter and for us it would just have been a different reason for cancellation, but the result would have been the same. In a nutshell: you can be fully willed to follow all rules and regulations, but still you would end up in the same negative result .

Only ever had an SKTT and Surat Domisili from my local Kepala Desa for 4 Kitas renewals and my Alhi Status / Kitas to Kitap conversion . Seems with the new e-visa system and the Scam in Bali they are requirering more and more documents . I recently had to provide proof my deceased wife had been my sponsor for the last 11 years although they have sponsor letters from all my Kitas renewals and Change from Kitas to Kitap conversion on file somewhere , they also required the receipt for my new passport from the Australian Consulate when applying to change my details after her death . I think someone has cracked the whip and they are all scared .

Now I disagree . By Law you should get the SKTT as soon as you get a new ITAS .
Marcus this is what I don't understand, I always apply for the SKTT after I have renew my Kitas (I considere myself very lucky in this case, because they give me the SKTT in the same day when I applied), so should have no him add on line the SKTT already he had from the Kitas was about to expired? the process is first kitas after SKTT right? why he had to apply for a SKTT in order to renew his Kitas? maybe I didn't really understand what happened to him.
