Buying land

i have seen some people succeeded setting up their business and "owning property" in Indonesia. To put it simply, they find good partner here.

And talking about ‘trustworthy’ partners: See the Jeremy Thomas case in BALI. Greed is a nasty thing.

I was talking about this Alexander/Thomas case as being irrelevant.
If you wish to hash about the legal problems associated with nominees a better example would be the Susi Johnston case......

Right.

The buying under a nominee loophole is being closed up.
Hence the frequent ads stating villa for sale or swap property in Perth, as people rush to unload their property before its reverted back to a leasehold status.

There is a way to own your own home legally as a bule in Indonesia.
Its a project I have been working on for a while and I will reveal a bit more when the time is right.

Well.......I fancy myself a bit of a property developer.........I have a property and at some point I will sell it and develop another one in Bali. I will manage it by swiping the floor etc.. :smile:My portfolio will be simple with low stress :hat:But on topic I would not trust most people to invest in property as a foreigner.

You think? I consider it to be extremely relevant since everyone who toys with the thought to ‘buy’ in Indonesia, will one moment in time be confronted with the Nominee setup. So also the OP.

We don’t hear that much about it but it seems there are more than 100 active disputed land case before the courts. Only in Bali.

And law firms as Bali Safe Harbor still claim it’s possible to create a PT which can also own land.

Do you have any reference that any one of those cases being relevant to any foreigner, other than I suggested about ' Susi Johnston', that is before the Bali court?

i am sorry my post have made some confusion, by "partner" in my previous post i mean business partner. someone who will have share in the new company and share the burden in making the new company, i only assumed there will be a company from OP post. regarding Hak Pakai can also owned by individual jstar are absolutely right. i only try to help answer the OP question.

as for nominee setup, i would say stay away from it. i heard it is banned now but i am not sure the source so i can't say for sure.
lastly for legal advice on purchasing land or business setup/partnership, i advice against using lawyer service, go to notary or designated land officer/ PPAT instead.

i hope this will clear some confusion, good luck and have fun

1. How is that being closed? If one reads Indonesian law on property ownership in RI there is not one reference to a 'nominee ownership' or loophole.
This terminology was used by realtors to imply an Indonesian 'nominee', for a fee, could hold the property title 'in lieu' of the foreigner. This is incorrect. The Hak Milik title holder is the one whose name is on the Hak Milik title...period!...The foreigner thus gives up ALL title rights to the person so named on the Sertipikat Hak Milik (heirs and successors).

However, a notary may then make a contract and add to the Akta Pernyataan (Deed of Statement) between the 'nominee' and a foreigner as to the benefits to the use of the property but, in no way, can that circumvent the law of owning Hak Milik land. It is a contract between two individuals...same as any other contract or lease and perfectly legitimate.

The real issue happens when the Indonesian 'nominee' recognizes his/her real affluence and power and, has been suggested elsewhere, gets greedy!!!.

2. I look forward to your project...please keep us informed.

^ Find a woman you don't like and buy her a house. Was that Rod Stewart or Mick Jagger.

Or a man.
Buy me a house and I'll take a dare.

More seriously, there are a pile of dodgy schemes out there, and they're all run by schemers.
