KMILN - the new presidential rule No. 76/2017

I heard that Jokowi has signed a new rule that will impact us expats.
The broadcast message I got from my friend reads:

"UPDATE BUAT WNI DAN YANG SUDAH MENJADI WNA
PERPRES No. 76/2017: Pemerintah Berikan KMILN
Kepada Masyarakat Indonesia di Luar Negeri
Oleh: Humas ; Diposkan pada: 23 Aug 2017
Dengan pertimbangan untuk memberdayakan dan meningkatkan peran masyarakat Indonesia di luar negeri, pemerintah memandang perlu diberikan fasilitas yang memadai untuk dapat terlibat aktif dalam kegiatan perekonomian, sosial, dan budaya. Dengan pertimbagan ini, pada 3 Agustus 2017, Presiden Joko Widodo telah menandatangani Peraturan Presiden (Perpres) Nomor: 76 Tahun 2017 tentang Fasilitas Bagi Masyarakat Indonesia di Luar Negeri.
“Masyarakat Indonesia di Luar Negeri adalah Warga Negara Indonesia serta Orang Asing yang menetap dan bekerja di luar negeri,” bunyi Pasal 1 ayat (1) Perpres ini.
Mengenai pengertian Orang Asing itu sendiri disebutkan dalam Perpres ini adalah orang yang bukan Warga Negara Indonesia yang mencakup eks Warga Negara Indonesia, anak eks Warga Negara Indonesia, dan warga negara asing yang orang tua kandungnya Warga Negara Indonesia yang menetap dan/atau bekerja di luar negeri.
Menurut Perpres ini, Pemerintah memberikan Kartu Masyarakat Indonesia di Luar Negeri (KMILN) kepada Masyarakat Indonesia di Luar Negeri yang memenuhi persyaratan dan kriteria tertentu sepanjang tidak memiliki masalah hukum dengan Pemerintah Republik Indonesia.
“KMILN sebagaimana dimaksud diterbitkan oleh Kementerian Luar Negeri untuk jangka waktu tertentu,” bunyi Pasal 2 ayat (2) Perpres ini. Sedangkan persyaratan, kriteria, serta tata cara penerbitan KMILN ditetapkan oleh Peraturan Meneri Luar Negeri.
Dengan memegang KMILN, Perpres ini menyebutkan, Masyarakat Indonesia di Luar Negeri diberikan fasilitas berupa: a. Membuka rekening di bank umum; b. Memiliki properti di Indonesia; dan/atau c. Mendirikan badan usaha di Indonesia sesuai dengan ketentuan peraturan perundang-undangan.
Dalam hal peraturan perundangan mensyaratkan KTP dan/atau kartu keluarga, menurut Perpres ini, KMILN dapat digunakan sebagai persyaratan dalam mendapatkan fasilitas sebagaimana dimaksud.
Pemegang KMILN yang merupakan WNI tidak memerlukan adanya izin tinggal atau izin kerja,” bunyi Pasal 4 Perpres ini.
Perpres ini menegaskan, Instansi Pemerintah memberikan kemudahan bagi pemegang KMILN dengan mengacu kepada ketentuan dalam Perpres ini.
“Peraturan Presiden ini mulai berlaku pada tanggal diundangkan,” bunyi Pasal 6 Peraturan Presiden Nomor 76 Tahun 2017, yang telah diundangkan oleh Menteri Hukum dan HAM Yasonna H. Laoly pada 4 Agustus 2017 itu. (Pusdatin/ES)

Have you folks heard about this? Is it not hoax? If not, this would supersede KITAB would it not? What do you think?

It is not a hoax, as it is on the official goverment website at http://setkab.go.id/perpres-no-7620...n-kepada-masyarakat-indonesia-di-luar-negeri/

It mainly affects ex Indonesians.
However, the implementation at this point is unclear, we will have to wait and see.

IMO is the long awaited 'diaspora card' that the President and Foreign Minister promised when they went to New York a couple of years ago.
My translate is from google, so would appreciate if others have a better translate, but it does appear to effect those, like my wife, who lost RI citizenship when adopting another citizenship abroad and those working full-time overseas....

With consideration to empower and enhance the role of Indonesians abroad, the government considers it necessary to provide adequate facilities to be actively involved in economic, social and cultural activities. With this consideration, on 3 August 2017, President Joko Widodo has signed the Presidential Regulation (Perpres) Number: 76 of 2017 on Facilities for Indonesian People Abroad.
"Indonesian People Overseas are Indonesian Citizens and Foreigners who live and work abroad," read Article 1 paragraph (1) of this Presidential Decree.
Concerning the definition of a Stranger himself mentioned in this Presidential Regulation is a person who is not an Indonesian Citizen covering former Indonesian Citizens, ex-Indonesian citizens, and foreign nationals whose natural parents are Indonesian citizens residing and / or working abroad .
According to this Presidential Regulation, the Government provides Indonesian Overseas Community Card (KMILN) to Indonesian Communities Abroad that meet certain criteria and conditions as long as they do not have legal problems with the Government of the Republic of Indonesia.
"KMILN as referred to issued by the Ministry of Foreign Affairs for a certain period," read Article 2 paragraph (2) of this Presidential Regulation. While the requirements, criteria, and procedures for issuing KMILN shall be stipulated by the Regulation of the Minister of Foreign Affairs.
By holding KMILN, the Presidential Regulation stipulates that the Indonesian People Abroad are given the following facilities: a. Open an account at a commercial bank; B. Own property in Indonesia; and / or c. Establishing business entities in Indonesia in accordance with the provisions of legislation.
In the case of legislation requiring KTP and / or family card, according to this Presidential Regulation, KMILN can be used as a condition to obtain the facility as intended.
KMILN holders who are Indonesian citizens do not require a residence permit or work permit, "read Article 4 of this Presidential Regulation.
This Presidential Regulation affirms, Government Agencies provide convenience for KMILN holders with reference to the provisions in this Presidential Regulation.
"This Presidential Regulation shall come into force on the date of promulgation," read Article 6 of Presidential Regulation Number 76 of 2017, which has been enacted by Minister of Law and Human Rights Yasonna H. Laoly on 4 August 2017. (Pusdatin / ES)

I just read the actual Perpres (not the press release), and I don't see any substantial differences to the status quo.

It divides KMILN holders into 2 categories: WNI and orang asing. Ex WNI are classified under orang asing.

Then it goes on to say that KMlLN holders who are WNI do not need stay or work permit (well duh, they don't now either, they're WNI)

For KMILN holders who are orang asing, it says they will be given special consideration, but defers what those are to (future?) Undang-undang.

In other words: it is just another meaningless card. At least for now.

I read yesterday there is some concern those of dual-citizenship now, due to mixed parentage, will revert to their WNA status when of decision-age and Indonesia may lose some of that talent....which has a simple answer but that they'll f+*k-up as well.

Yes, I am thoroughly disappointed reading that Perpres. It basically just provides for making a new ID card, without any privileges attached to it. Total waste of space.

To be fair, in the hierarchy of laws, a Perpres is fairly low, and the things that the Indonesian diaspora wants (dual citizenship, right to own property for ex-WNI, right to work etc) are all regulated by much higher law (Undang-undang). So the president alone (nevermind his ministers) is powerless to change them.

In order to issue a new Undang-undang, DPR needs to work on it, and there is simply nothing there to motivate them. I mean it's not a multi-trillion rupiah e-KTP project...ya know?

Does it override Undang-Undang (UU) Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria?
Does it mean a couple (foreign nationality & Indonesian) without prenup may own property in Indonesia now?

Being of lower hierarchy of an UU it can NOT override it. In fact it just says that owning property may be a possibility, but has you certainly noted the type of title concerned is not noted.

I haven't had time to go through the PerPres but usually there is an article which says that "all stipulations will be further detailed by a PPP/PerMen/PerDa...etc.

OK... I confirm what I wrote above. In fact the text pasted in the OP may lead to a wrong interpretation due to its format. In the original PerPres the article is redacted as follow:

Fasilitas bagi pemegang KMILN yang merupakan WNI, berupa:
a. membuka rekening di bank umum;
b. memiliki properti di Indonesia; dan/atau
c. mendirikan badan usaha Indonesia,
sesuai ketentuan peraturan perundang-undangan.

The "sesuai ketentuan peraturan perundang-undangan." is not only attached to point c. as it could be understood in the OP but is valid for point a., point b. and point c. Therefore no way that a SHM get issued to an eks WNI who would have a KMILN. S/He will have to look for the titles authorized by UU to WNA.

Also the same article stipulate in its ayat 4, the same formulation appears:
(4) Bagi pemegang KMILN yang merupakan orang asing, dapat diberikan fasilitas dan kemudahan, sesuai ketentuan peraturan perundang-undangan.

In short, if you are a WNA, you get what is authorized to WNA.

Thanks for your input, and the link, but it has nothing to do with this thread.
That thread was about WNI of mixed marriage permitted to own Hak Milik property by using what is called a post-up. This thread is about the new diaspora card being issued to ex-WNI living abroad.

I also read it and come to the same conclusion.
The only benefit to a WNI is they will not need to declare their residency in RI. Not a big deal as I'm sure WNI overseas have family in RI and that address can be their residence for those purposes. My wife was on her brother's KK for over 30 years while she lived in Hong Kong and Canada. We had it removed when she returned to live in RI.
