Hi all.
I just now remembered that our Daughter's affidavit is due for renewal since 26 Jan.
Is there a penalty deadline for the renewal with her bew US passport?
 
My understanding:
Affidavit is only mandatory if the foreign passport is used to enter/exit/stay in Indonesia.
If an Indonesian passport has been issued and is used for international travel, then Affidavit becomes optional.
 
My children's affidavits are never asked for; we use their Indo passports for exit/entry to ROI and their foreign passports for overseas entry/exit.
 
An affidavit is not just a piece of paper, it does indicate the child also has the Indonesian citizenship and that a visa is not necessary. So of course it is only required if your child with dual nationality chooses to use the foreign passport for international travel (to Indonesia) to exempt them from visa/stay permit requirements.

As far as I know there are no fines for not having one but you can guess what could happen and the possible consequences if the kid goes through immigration.

We were told by immigration that affidavits are compulsory, even though the kids have both passports. Having said that nobody has ever asked to see them.

From the 2023's Regulation , Article 1 and 8 (see below) I understand that the Affidavit may only be required if a dual citizen has only a foreigner passport and needs to enter Indonesia without an Indonesian Visa , and stay/live/exit (in) Indonesia without an Indonesian Stay Permit . Even in this case I understand that the Certificate of Registration of dual citizenship (Article 7) could be used , instead of the Affidavit . Finally , I cannot understand the existence of this Affidavit .

Article 1
6. An Affidavit is an immigration document attached to or added to a foreign passport that states that the child holds dual citizenship and provides immigration facilities to the holder based on statutory provisions.

Article 3
(1) Children with dual citizenship must be registered by their parents or guardians.

Article 7
(1) The Certificate of Registration of children with dual citizenship shall be submitted to the applicant electronically.
(3) The Certificate of Registration may be printed on A4-sized white paper.
(4) If a child with dual citizenship holds an ordinary passport, in addition to being provided with the Certificate of Registration , information shall also be provided on the endorsement page of the ordinary passport of the child with dual citizenship.

APPLICATION FOR AN AFFIDAVIT
Article 8
(1) Every child with dual citizenship who holds a national passport may be granted immigration facilities in accordance with statutory provisions.
(2) To obtain immigration facilities as referred to in paragraph (1), proof must be provided by an Affidavit.
(3) Immigration facilities as referred to in paragraph (1) include:
a. exemption from the requirement to have a visa;
b. exemption from the requirement to have an immigration residence permit and re-entry permit; and
c. issuance of an entry or exit stamp that is treated as an Indonesian citizen.

Article 10
(1) The application for the Affidavit must be submitted by attaching the following requirements:
a. the child's national passport;
b. Certificate of Registration of the child with dual citizenship; and
c. A recent color photograph of the child with a white background.

Article 12
(3) The Affidavit ... must be printed on white paper measuring 8.56 cm x 5.39 cm .
(4) The Affidavit must be attached or included in the passport of the child with dual citizenship.
(5) The validity period of the Affidavit is the same as the validity period of the national passport and cannot exceed 3 years after the age of 18 .

Article 13
(1) A child with dual citizenship who holds an Affidavit ... must use the same passport when entering and leaving Indonesia .

Article 14
The Affidavit is declared invalid if the child with dual citizenship who holds the Affidavit:
a. marries ; ......

Based on my experience in "april 2024" with renewing both my children's Indonesian passports through the Tangerang Immigration office : an unexpired Indonesian Affidavit is mandatory when renewing the Indonesian passports for those children under age 21 years.
The child's valid/current Indonesian Affidavit is 'linked' to the expiration of the child's foreign passport.
In "april 2024" I had to pay fees for both my children's 'renewed' Indonesian Affidavits, and pay fees for their 'renewed' Indonesian passports.

Instead of the Affidavit you could have provided the "Certificate of Registration of child with dual citizenship" mentioned in Article 7 of PerMen no.10 Year 2023 (see post no.8 above and the Regulation below) .

For a child with dual citizenship who are domiciled or residing in Indonesia, applications for a regular passport must be submitted ... by completing the application form and attaching :
a. KTP of the Indonesian father or mother;
b. KK;
c. marriage certificate or marriage book of the parents;
d. birth certificate;
e. immigration stay permit of the foreign father or mother;
f. photocopy of the father or mother's regular passport;
g. affidavit for those who already hold a foreign passport or proof of registration of the child with dual citizenship; and
h. a written statement from both parents stating that they are responsible for the use of the Indonesian travel document.
 
My Wife and Daughter went down to Immigrasi on Monday. Application and picture taken. All done that day. Should get the card in another day or two. No drama.
