Hi all,

I have not been a regular visitor over the last couple of years for a number of reasons primarily due to health, a new member of our household, involvement elsewhere and travelling. However, I intend to become a regular again as I always found answers to my question here.

My wife has sold the house in Bekasi and we are moving to Manado in about 7 weeks. We are going to rent while we build a house on land she owns.

I have always been of the understanding that assets that were acquired before marriage remained the property of each party. Therefore, we have never worried about getting a post nuptial as I also retain the financial assets from before marriage in separate accounts. I always thought that the house was her asset and she could do what see liked with the asset.

She purchased the house a couple of years we met and the other property I part financed before marriage but the transfer was declared during tax amnesty.

I am now a little confused after reading some old posts on the subject where it stated I need to give approval for the sale. So I thought I would ask for some guidance if my understanding is correct or incorrect as settlement is fast approaching.

Also when we move I know we need to transfer address for ID's, KITAP, KK and so on but does anyone know how long you have to do the transfer. Normally no problem but with covid-19 I am a little concerned and it is also my upstanding that in any case the immigration offices are very restricted in what they process at present.

Just have the notaris look it over during the sale. The "proper" way would be the notaris / BPN will see that the property pre-dates the date of your marriage, so only your wife will need to sign. If they are not up-to-date with their law (and many notary's won't be), they may ask you to sign, and/or provide a statement agreeing to the sale. Just follow along with their instructions to get BPN to approve the sale.

Also when we move I know we need to transfer address for ID's, KITAP, KK and so on but does anyone know how long you have to do the transfer. The KITAP holder needs to report within I think 30 days of move? But it may require your wife to first move her KTP and KK, so that should be done first. Your wife needs to arrange this via her local Catatan Sipil office, and you will also need to report to imigrasi that you are planning on moving.
