Deport/Blacklist overstay..Baby with Aus parents not married born in Bali,

Hi .. Om swastiastu ?. Hoping for some guidance on our situation

We arrived as a family of 3, from Australia
, my partner (not married) and 3 year old on a 6 month social visa on the 26/10/2018
On the 18/11/2018, Our son was born to our surprise at our friends place.

We had a bidan in Ubud say she can do the birth certificate, paperwork but she changed her mind.

We contacted our visa agent who organized his birth certificate which we received and we sent to Australian embassy in Jakarta ..

Our agent said she can sign the forms we needed to fill out to go with the birth certificate for the citizenship of decent , but the embassy said she is not qualified.

We then found a bidan in north Bali where we were staying to do the paperwork and this was accepted by the embassy.

We then took the Citizenship of decent paperwork to the Australian consulate in Denpasar to apply for Adams passport on the 1/3/2019.

They assured us at the time that the
the paperwork was correct.

Two weeks later we received an email from Australia saying it was filled out incorrectly and we had to do it again .

We have done this and now FINALLY we have his passport in our hands.

He does not have a visa yet so will he be deported? We have been told that there is no fine now as it’s well over 60 days after his birth and he is deport and black listed. How does this work?

We would like to leave Bali as soon as possible. My wife is very stressed with the whole ordeal. What is the best way to go about this?

We have heard different stories about being fined 300k every day?!
Or that no it’s ok he is under the parents visa.
Also the consulate says that because is over 60 days there is no fine..
We were also advised that we couldn’t go to immigration for a visa until we have the passport..

So do we go to immigration Denpasar or go to airport and sort it there?

Adam entered Bali obviously with no visa as he was in Mary’s belly.

Can you please advise us the best way to deal with our situation. As stated, we have been here for over 5 months

Any help would be great.

This is fairly strange. Most airlines don’t allow you to fly if you are over 6 months pregnant. You must have planned to have the baby there if you obtained the 6 month visas. Is there a reason the baby wasn’t born in a hospital?
 
Did you report the child's birth to immigration? You were supposed to do so within 60 days. If you did (or your agent did), then your child should be fine.

Once you have a passport, your child will automatically get the same visa as his parents.

I would suggest you go to immigration office first to sort this out.
 
Hi @welovebalitho , welcome to the forum, and congratulations on your newborn.

I agree with the above responses. Your first course of action is to go to the immigration office in Denpasar, with all the paperwork you have (passport/birth cert/etc), and register the newborn.

They speak pretty good English and are mostly professional, so no reason to delay. Go to the office as early as possible (they open at 8 am M-Th, Friday a bit later) and you hopefully can skip most of the lines.

Now for some legal talk:

1) Foreigner children born in Indonesia are entitled to receive the same visa type as their parents.
2) You are required to register within 60 days of birth. This is normally a generous time limit, but you do have extenuating circumstances, so you can explain it to them.
3) To be overstayed, you have to enter Indonesia on a valid visa, through a valid port of entry. This doesn't apply to your newborn's situation.

My feeling is that they're probably going to chew you out a bit for being late in registering, but seeing that the passport only recently arrived, I'm sure they can sympathize.
