Spousal KITAS to KITAP conversion

I have started the process to convert my Spousal KITAS to KITAP. My KITAS expires on 3 September 2017.

I could only submit the application 14 August as I had to visit Australia and needed my passport. The same thing happened last year so on that occasion I decided to renew the KITAS and wait a year.

This time the lady at Immigration pointed out that I was submitting the request 20 days before the KITAS expiry and they require 30 days. She also pointed out that if the application was not approval I would be in breach and would have overstayed my allowed time in Indonesia.

Everything she said was correct according to my understanding but I said I was prepared to take the risk so I asked for the application to be processed.

Now I am worrying big time that I have made the wrong call.

I would have expected a visit from immigration to our house by now given how very efficient Bekasi Immigration is but I have received no notification on a visit. My previous KITAS applications have been processed in less than a week by them.

Once Bekasi office is finished with the application it then needs to go to Bandung for approval. So time will march on and my KITAS will expire in 11 days.

I now thinking about going to Bekasi Immigration on friday and asking just to process a KITAS. I don't really want to end up having to start again from scratch.

I would greatly appreciate some advice from experienced forum members on what I should do. Wait or withdraw the application and apply for a KITAS renewal.

Is there any reason for you to think the application would not be approved? Once the application is accepted by immigration, the approval chance is very high (if not 100%).

I am not sure if she is correct about the fact that you would be in overstay, because after all they accepted the application and you have the dated receipt of the application. FWIW, you can apply for an extension on the last day of the validity of the KITAS, and it could also theoretically be denied.

Finally, worst case scenario, you are denied conversion and she is right that you would count as overstay, how many days are you looking at overstaying?

Thanks for the response. There is no reason what so ever to think that the application would not be approved. In fact that is what I said to Immigration lady.

I suspect in the worst case scenario is I would overstay 30 days if there were delays.

You are right they have accepted the application and date stamped and they have given me a receipt for the passport, So that should count for something.

I worry by nature and I am probably over analysing. It's just that I read horror stories from people posting here and think that one day it may apply to me.

I reality I have had no administrative problems since I moved to Indonesia and generally have had great service from government institutions.

I will go in next week on the 2 September and ask for an extension of my KITAS.

Sept 2 is Saturday, Sept 1 is Idul Adha (public holiday).

Also, to be clear, I didn't mean to imply that you should go in on the last day and ask instead for KITAS extension. That observation was only meant to point out that immigration accepts extensions at the very last day of validity, and we would hear many cases of overstaying if those were denied.

No I understood what you meant. My comment meant I would go in late next week and at least ask if they would consider extending the KITAS for a short period while the KITAP was processed. I know that the response will likely be no but at least it would be on the record.

Fortunately my wife has a business background and hopefully she can use a bit of her "client charm" to help speed up the process.
 
If they accepted your application & your passport, I don't see how they can bill you for overstay. It isn't as if you can leave the country now, they have your passport.
I had a similar thing a few years back- I think it was the SosBud to ITAS... but my application was passed & I wasn't billed (but I was worried at the time that I might be).
 
I believe that, If they have accepted your ITAP application you will not be able to change the application to an ITAS extension.
 
As with Ms BA, we recently applied to move from Sosbud to Itas and were assurred by the Immigration officers that we would not have a problem if our Sosbud expired during processing.
