Autopsies, what goes on

I thought we had a thread about the strange Jessica case but I cannot find it, but any here goes, I just caught the some of the Australian pathologists statement which he said there was no cyanide in the dead girls body, so what was the cause of death, nobody seems to know, she was buried almost immediately, no post mortem, the mug, straw the dead girl used destroyed, how was it determined after burial she was poisoned with cyanid, the police their usual inept selves, the daftest thing I heard was the judge asking the pathologist what post mittens were for, now to add the the Australian pathologist woes, he has been arrested, for working on a tourist visa and not a work visa, how stupid can this lot get, immigration actually stopped him going home, and are now saying what charge, I fear the loonies are now running the hospital, but I would be interested if any of are dear readers can make any sense of the mess, which in many ways reminds me with the JIS farce
 
I guess he is released but got blacklisted (6m)? What a joke.
 
Blacklisted, I don't think he is in a hurry to come back or any of his colleague, must be a few rupiah tied up in this farce

Deported and Blacklisted for 6 months. He may have needed to come back in case of an appeal but this pretty much stops that. Immigration said they seen the doctor on TV while watching the trial and then took an interest in him. I would be willing to bet their interest came from the prosecution.

As for the cyanide found in the system, while the family refused to have an autopsy performed, the police were constantly on their case to have one so they could have any evidence. The family finally agreed two days after death that the body was raised and a needle sample from her stomach was removed. This sample showed cyanide below the lethal limits but the prosecution witnesses were quick to add that after two days the sample could be much smaller so they state it was bigger when she died. They do not have anything that says just how much was actually in her system but are still able to say they know.

What passes off as professionalism here among people that hold other peoples destinies in their hands is truly terrifying when you think about it.
 
I saw this news today and felt it was a new low in the way the authorities here treat foreigners. According to the JP:

On Monday night, the foreigner monitoring team visited the court to observe Ong and the next day the Immigration Office confiscated his passport for investigation. The passport was returned upon his deportation.

Pathetic, one would have thought these characters had better things to do with their time that watching an expert witness on TV. He's been blacklisted for 6 months, but I guess he's one visitor who's not going to be in a hurry to return.

His deportation does NOT cause any problem for the trial and/or subsequent appeals. The most important being that he has testified in court under oath. For appeal and cassation NO hearing of past witnesses or new witnesses occur. An appeal is just a reviewing of the evidences by a new set of judges.

In the UK an unexpected death particularly of a young person results in an autopsy that will be held automatically, but here not so, Mina was buried then dug up, and hardly what you describe a full autopsy, just sticking a needle and see what's what, don't really class that as very professional, then there's the case of the young girl whose neck was allegedly broken by a chiropractic practitioner, again examined 6 months after death, so are autopsies mandatory, or is it a bit hit and miss, or you have one if you feel like it, there is of course the mad rush to bury, does this override an autopsy, seems one could murder someone quite easy by not allowing an autopsy and Bumping off a relative

The family can say no autopsy and that is the end of it, it seems. I don't think there is a mandatory autopsies law here for any reason.
 
I believe (I may be wrong) if the police feel there is suspicious circumstances involved they can demand an autopsy
 
Weird system then, leaves it open for mega misuse, still that's indonesia

Mirna would have been a suspicious case and the police kept asking the family and they kept saying no. So, I'm not so sure about the police requesting it.

asking more questions I'm afraid, if the parents didn't want a post mortem, how on earth has it spiraled to this situation, long trail, so called expert witnesses, foriegn specialist, accusation of killer for hire, you couldn't make this up

First off, it's an Investigation taking place in Indonesia where it seems if the police have an interest in someone, game over for them. no one else is even remotely considered. They put together the evidence they think they need and go to the Prosecutors with it. In this case, it was rejected a few times. In the end, the police put together a bit of what they feel is evidence and a bunch of Expert witnesses. The expert witnesses are working on the if this happens then this happens and point it at the defendant. While those from nations that have fair justice systems that require a smoking gun, it is my understanding the hearsay is allowed in these courts and that physical evidence isn't always necessary and it always comes down to the judges decisions. Motives don't seem to play a major role either since the Prosecution seems to keep changing it. At least the judges did say enough is enough to the motive courses. If the judges weight what evidence there actually is in this case they will in all likelihood toss it out. History does not indicate that.
 
well as I said I couldn't find the original thread regarding Jessica, but I was more interested in the legal side regarding autopsies and post mortems as it all seemed a bit vague, no intention to derail someone else's thread, if that's the impression
