VOA extension advice?

Hi,

Wondering if someone can give some advice please. My family and I have been travelling across SE Asia during the last almost couple of years (I have been using the VOA while in Indonesia).

Then at the end of 2019 I got in contact with a law firm to start a PT PMA business in Indonesia (which is now complete), however when the KITAS process was started, the mess of covid started too, so I'm currently in Indonesia on a VOA (now emergency stay permit) which has already been extended once, in March.

The recent announcements has caused confusion for me in terms of what's the best step to take next? Ideally trying to avoid travel, as frankly this covid situation is pretty terrifying, also most countries either not allowing tourist visa or have stringent requirements.

Any advice would be very much appreciated.
 
Not to sound like an arsehole but they are several other threads and posts already even today about this

You have 30 days from 13th July to either leave the country or if you have not already extended your paid VOA you can apply to extend it 30 more days. But that must be done and stamped before 12th August.

Just use the search function and see the number of other threads this week about this.
 
Or start the process of your new KITAS but I think you must be on visa free entry stamp for that

As of July 22nd, you can now apply for a SosBud (or VITAS if you are eligible) within Indonesia, and you are no longer required to leave Indonesia to visit a consulate abroad to get it activated. In your case, you may be able to even resume your KITAS process. Check with your agent or local immigration office.

Thanks everyone for the replies, yes I had seen the couple of other threads somewhat related to this, however, reason I posted a new thread was I wanted to clarify what's best step in the case of current/expired VOA while a KITAS/work permit already in progress.

Wondering if mentioning my in-progress KITAS to imigrasi would pose any risk? (for the record I've never worked in Indonesia)

Also is it worth getting a reference letter from the law firm dealing with the KITAS?
 
Where is the IMTA coming from for your KITAS?
Not sure why you have a law firm dealing with your KITAS
I didn't think VOA could be transferred to a KITAS? Usually you have to come in on the free version and convert that.
IMTA is the work permit from your sponsor company etc and the KITAS is the visa to stay / live here.

What did your company HR department suggest? Or the agent?
 
I used the law firm to form my PT PMA business here, as I'm the main shareholder, my IMTA is being sponsored by my business.

As you mentioned about VOA not transferable to KITAS, this is partly where my confusion is coming from. From all the announcements/posts I've read, my specific situation doesn't appear to be addressed.

My company is still dormant as I'm not yet allowed (due to lack of work permit & KITAS) to do any business activity.

The law firm have said they can supply a reference letter to indicate I do have a KITAS in progress, however their concern is it might arouse suspicion that I am working here.
 
So the company has been established? Izin prinsip from BKPM in Jakarta and Akte Pendirian certified by your province? Are you planning on getting an IMTA work permit or simply get the Shareholder/Director KITAS?

My advice would be to try and get the KITAS first, if you're not able yet, then pursue the ITK while you keep working on the KITAS.
 
yes, company has been established. BKPM & Akte Pendirian are the stage things are at now from my understanding. IMTA work permit + KITAS is what the law firm currently working on.

so I will try to go ahead with pursuing the ITK, question is, do I get a reference letter from the lawyers stating I have a KITAS in progress and show imigrasi? or could this potentially hinder things for me?

@someuser Your company is not established if you do not yet have finished Izin Prinsip and Akte Pendirian, and after those you likely need a few more steps before you can get your KITAS, like Nomor Induk Berusaha and NPWP tax registration. If you are a significant shareholder in the PT PMA, you don't need to get an IMTA as long as your activities are "Director" activities, you only need an IMTA (and pay 1200USD/yr for the privilege) if you want to work as a specialist in the business.

So yes, it seems as though your KITAS will not be ready soon, you should pursue an ITK, which requires a sponsor. You could be sponsored by a local friend or a lawyer who you are paying, the fact you are working on a KITAS and business need not be a secret.
 
@r-cameron.62, I've just checked all the paper work and emails with the lawyers; and the business establishment process has indeed been complete, these processes are all done; Akta Pendirian, SK Menkumham, NPWP, NIB, Izin Usaha (not sure if different from Izin Prinsip?) - and have the respective documents. (I'm getting lost in the terminology so apologies for the misleading re Akta Pendirian)

I will proceed with pursuing the ITK, and I will get a reference letter which hoping will strengthen the case.

@someuser If all those documents are complete, you have everything you need to apply for the Investor KITAS, and I see no reason ITK would be any faster or easier. The IMTA could take longer, but, as I said above, that is only necessary if you want to work in the business as an employee, such as being the chef in a restaurant or dive guide in a diving company. If you do determine you need an IMTA, ask your lawyer, but it may be possible to add an IMTA to your Director/Investor KITAS after you have it.

thanks @r-cameron.62, but because of the share structure and as I will be working as an employee in the business I've been informed by the lawyers that I will need an IMTA first.
