VITAS to KITAP in only 10 WEEKS!

Based on article 61 of the Immigration Law, only the spouse sponsored KITAP holder has the right to work and this is clearly stipulated. The law wants the Expat to be able to earn a living for his family.
• The Expat can choose to work as a sole entrepreneur (and avoid the hassle and dazzle of the IMTA, the work permit)

Yaya.

This is the text of that law you use the quote from:

Pemegang Izin Tinggal terbatas sebagaimana dimaksuddalam Pasal 52 huruf e dan huruf f dan pemegang IzinTinggal Tetap sebagaimana dimaksud dalam Pasal 54 ayat(1) huruf b dan huruf d dapat melakukan pekerjaandan/atau usaha untuk memenuhi kebutuhan hidupdan/atau keluarganya.

And as you can see, they mention in this pasal 61 of UU 6/2011 both ITAS and ITAP holders.

I will include an (informal) translation:

Holders of Limited Stay Permit referred to in Article 52 letters e and f and Permanent Stay Permit holders as referred to in Article 54 paragraph (1) letters b and d can do a job and/or business to make ends meet and/or to provide for his/her family.

As far as I know, you can support your family on a KITAS when working in for example your spouse's business (store, office) to help out when she can't work, but you can't work as a sole entrepreneur. On a KITAP you can work as a sole entrepreneur. Because you have a permanent residence status, you can work as an entrepreneur, you can't do that on a temporary residence permit.
In my opinion, the regulations you quote just state that when you have a KITAS/KITAP WNI, you can be hired by any company and get easily your own work permit.

There is no difference for spousal KITAS or KITAP holder regarding their ability to work in Article 61 of UU 6, 2011, or any other law. In fact it is one long run on sentence covering both spousal and ex WNI KITAS and KITAP holders.

Whats the cost to convert KITAS to KITAP?

Nobody is challenging that you can not request it right away. (When you're married for two years that is, there use to be a minimum amount of KITAS-es before.) But the pertinent questions was, why would you spend the money when you can also 'use up' the ITAS first? Villaparadise answered that by (mainly) summing up the ITAP advantages. (I could add one in his case; just get it over with. The red tape that is.) No problem, everybody's personal choice.

Exactly my point Jstar who the hell wants to wait for their KITAP when they can get it in 10 WEEKS. If I wait till my KITAS is used up, they may change the rules or increase the fees, or who else knows what. The KITAS was only $160 USD at that price why wait for your KITAP, especially when you have all of the documents in your hand ready to go. It's a no brainer!

For science!

Seriously, I think it's a great idea, even if just to see if it can be done.

What's even better is that you've decided to share your experience with us, so thank you for that and keep us updated!

Great news! I will be getting my KITAP photos and fingerprints on Monday it only took 2 days to get final approval from the Director General of Immigration. The total procress from VITAS, ITAS, KITAS, ITAP, to KITAP will be only 9 weeks in my case. I want to say that Immigration is very friendly, helpful, and always professional at every office I visited.

I've never done the KITAS myself but have a question for my relative who's married to a Singaporean. He (Indonesian) goes back and forth between Indonesia/Singapore, wife will travel with him. Does she need a VITAS before applying for spouse sponsored KITAS?

If they go back and forth, then VITAS -> KITAS route seems easiest. Just have them do an Online VITAS application before they go to Singapore next time, then come back and convert it to KITAS.

Dafluff, my understanding is that if a foreigner applies for a VITAS, she/he needs to be outside indonesia to do it? Either case, looks like she has to do VITAS first before converting to KITAS, correct?

In immigration terminology, it is important to understand that a Visa and a Stay Permit are two different things. A Visa is simply a pre-authorization to enter a country. A stay permit allows you to stay in the country while complying to the conditions of the stay permit.

A VITAS is a visa, so it is issued at an embassy/consulate abroad. The VITAS needs first be applied for by the sponsor in Indonesia, then the approval of it will be sent to the Indonesian embassy/consulate where the foreigner is applying.

A KITAS is the actual stay permit. This is issued in Indonesia. Once the foreigner enters the country with a VITAS, they have 7 days to go to the immigration office in their area (or the area of the sponsor) to obtain the KITAS.

Technically speaking a VITAS does not convert to a KITAS, instead a VITAS is a visa that allows the foreigner to enter and immediately obtain a KITAS.

To answer your question: it is not the only way, but really the most practical.

An alternative way would be for the foreigner to apply abroad for a Visa Kunjungan (SosBud) sponsored by the spouse, then when they enter the Visa becomes an Ijin Kunjungan (stamp on passport). This can then be converted to a KITAS.

Thanks maybe it was my misunderstanding that citizen of ASEAN countries don't really need visas to visit each other (or at least they can apply for a VOA instead). Maybe for those who are intending to stay in Indonesia, they have to go a different route than the VOA.

ASEAN enjoy visa free 30 days. If that is all they need then no need for KITAS. Maybe it would help to first find out the needs of your friend, so they can match the visa to their requirements.

I asked this in another thread and asking again to get more clearer answers.
I have a KITAS since last September but it will expire soon. I have been overseas with my my wife, we will have been married 2 years next Feb. Can I still extend my KITAS we go back for a month after my KITAS has expired. I processed the KITAS myself and didn't go through an agent. It was so much cheaper.
Is there a way of getting an extension on my KITAS so I can extend it next month when we are back in Indonesia. We will have been married 2 years next Feb so I would like to apply for the KITAP then.
Do we really need to start the KITAS extension process a month before it expires>? I read somewhere that extensions can be granted.

If you have a procedure outlined for this I would be thankful if you could post it here.

As far as I know, there is no mechanism by which you can get at KITAP without getting a KITAS.
Yea Def you need KITAS first
