Hello, I will ask again if any of the posters have transfered the name on a motorbike title, from an Indonesian to a foreigner, that payed for the bike. My Balinese friend, gave me an answer that did not make sense to me. He said people sell bikes all the time, if they have the Blue book, even if the title is in someone else's name. This doesn't make sense to me. In America a person has to have their name on the title to be able to sell a vehicle. Also when they sell, it is required by the new buyer, to register the vehicle in their name, within 15 days. So the vehicle can only be sold by the title holder.

I hope I am not being confusing. Is it possible for me to sell my bike, even if the title is in an Indonesian name, if I hold the Blue book?
 
I think this sometimes has to do with taxes. If you pay the annual taxes on a car (or motorcycle) and then sell it four months later, the car does not need to have its taxes paid again for eight more months. The buyer might then want to wait for those months before paying the taxes. However, if you legally transfer the title, the annual taxes are due immediately—regardless of how many months the seller has already prepaid.
 
It's true that it is extremely common to sell a vehicle without transferring title, and the blue book (BPKB) is the most important document. You will also want a photocopy of the registered owner's KTP, and a Kwitansi with buyer and seller listed and signed by the seller on Meterai . This gives you everything you need to register the vehicle in your own name, and foreigner on KITAS or KITAP can (but I can't promise they'll make it easy). If you want to leave it in the Indonesian person's name, a common practice is to have them make an additional Kwitansi leaving the date, amount, and buyer blank for you to fill in later when you wish to sell. Technically that is probably fraud of some kind, but it is an extremely common practice.

My Indonesian friend just told me that it is relatively common people buying but not transferring the name in the document , because this process cost 10% of the motorcycle value .

But there is a negative point in doing that , he said that to pay the annual tax one needs the KTP original of the person whose name is in the document , if one has only a photocopy will have to pay bribe (maybe RP50'000 to Rp100'000) .

But as we cannot rely on what a person says :

- Atlantis recently (May 2024) didn't mentioned any need to bribe (see his post no.25 at https://www.expatindo.org/community/threads/buying-new-bike-in-someone-elses-name.7422/page-2) .
Information in the internet shows one needs the KTP original to pay manually , but not by paying online .

- Name transfer fees seem to be a lot lower than 10% (I think he referred to VAT which already changed to 11% or 12% and seems not applicable to private seller) .

also negative point to the seller. Due to progressive taxes, s/he has to pay higher taxes to purchase new one if the still registered under her/his name.
 
I seem to think you must have the shop sales receipt to change ownership. I'm told it's kept in the blue book.
That came from someone a while ago so should be checked for accuracy

I do have the sale receipt direct from Honda, and the blue book. But the name is my Balinese friend. I thought it would be a good idea, to have the title in my name for resale, if I wanted to resale. I have the Kitas visa, so it is allowed to be in my name I believe? This sounds like a major hassle to do something so simple!

I have had more stringent requirements when doing annual extension at the large SamSat offices, but at least 10 times I have gone to mobile SamSat keliling and SamSat drive thru and they have required nothing but the expiring (or expired) STNK. I've even seen SamSat keliling setup temporary kiosks at malls.

For the annual extension you also are not required to do it in the same area as the owner's residence, so if SamSat keliling near you are strict, try one when you visit a different area.

Of course this is Indonesia, so your experience may vary.

You can also pay your vehicle tax via Tokopedia, although this does not work for every province in Indonesia.

Go to samsat on your area and bring along all document (see link below in bahasa indonesia, google translate is your friend) + KITAS/KITAP for foreigner.

Trying to change the registered address of your car (in the BPKB) at Samsat, can take weeks and 5+ visits. It's crazy. At a time when immigration has got so efficient, samsat is stuck in the Soeharto era.

This is crazy! I don't want to go to an office 5+ visits, when it should only take 1 visit. I will just do the same all the locals do, and just sell the bike in someone else's name, because I have the bill of sell from Honda, and the blue book. If ever I want to sell the bike!

Really?, is it your experiences? Where samsat? and what the reasons you need 5 visits. Do you follow ythe procedures and bring along all required document correctly?

Changin address in BPKB is not done in one place, and different Samsat can be in charge. I gave up when I needed to do it.

Yes, we had all the correct documents (Jakarta). They keep sending you to get stamps\forms from different people queue up in one building for 4 hours then another building the next day for 4 hours. You have to bring in the car to do a detailed physical check of the engine for some reason. Lots of agents and superfluous staff hanging around. Etc etc

like immigration was 15 years ago before it became efficient.

yes, but how could be 5 visits - I did 1 and my driver collected. My BIL did 2 visits. The requirement to bring the vehicle is not something new.

Yes, they take 10 steps that are actually required and make each one 5x more complicated than it needs to be, all in the hope that you will pay "a little extra" to have them "help". Corruption abounds, and kasihan if the vehicle needs to move from one wilayah samsat to another, because then you're going to get hit double as you go to cabut berkas at the first and then register at the second.

I think it will be easier to get a big hammer, and bash the shit out of the bike, then pour petrol on it and light it on fire. And you don't have to pay for IDR. 40 Juta, for a cremation! 👍
