Spouse KITAS to Spouse KITAP

Hi, my spouse KITAS expires on 19th June 2025, I will have been married for 2 years on the 14th May 2025 which was the date of my wedding ceremony in 2023 however my marriage certificate has the date 25th May 2023 and it has the wedding ceremony date of 14th May 2023.

Does anyone know if immigration work from the date of the actual wedding ceremony or the date of the marriage certificate in regards to counting 2 years of marriage?

My other idea was to renew my spouse KITAS in May 2025 and then immediately apply for the KITAP however I've been told by agents it's not possible as the validity of the KITAS would be 1 year and I have to wait for my KITAS to have only 1 to 2 months of validity remaining before applying for a KITAP. They have said the online system will only show the conversion option 2 months before the KITAS expires.

Has anyone had anyone experience with this issue? I've seen on this forum from old posts that some people have managed to change KITAS to KITAP with 1 year of validity left on their KITAS however all the agents are saying it's not possible.

Your KITAS expired 19 June and your KITAP will start the same day. Doesn't matter when you submit your application. You could for peace of mind make a trip to Immigration and ask to see if your agent has any clue to what they are saying.
 
The first thing to understand is that there is zero use for an agent in the spouse KITAS/KITAP process. There is literally nothing they can do to help, you can do it very easily by yourself, paying the official fees.
Any questions you have, go to immigration and ask, they are always happy to answer.

Don't you have to apply for a Kitap stay permit, after a person's Kitap is expired? You seem to imply they get it automatically? Please explain?

I've been told I can't apply directly as you need over 30 days of validity left on the KITAS and my marriage will be for two years on the 14th May 2025 however immigration apparently work on the marriage certificate registration date which is the 25th May 2025 which doesn't leave 30 days of validity on my KITAS.

I don't understand what does your marriage have to do with you getting a Kitap Stay permit?

I don't know but i guess they will consider the date of the marriage certificate .

I don't know too , but I think it will not be difficult for you to check it yourself later in the evisa.imigrasi.go.id .

Theoretically I think it should be possible because the rule has only limit for the minimum days left before the KITAS expires (see below) , but because now the process is probably only possible online , it depends too on how the software was made .

A foreigner married to an Indonesian is eligible for a KITAP after his/her marriage completes 2 years .

I just read again what he said and he said ( your Kitas expires June 19th. And your Kitap will start the same day) isn't that implying it's automatically started on June 19th.?
And single people get The Kitap stay permit without being married, so why does it matter if he is married or not?
 
OK, my Kitas expires in June this year. So do I have to apply at the end of April for getting my Kitap? To be over 30 days before my Kitas expires?

By being married to an Indonesian , the foreigner has the benefit of being eligible for a KITAP quicker than if not (except if the foreigner is an ex-Indonesian) .

Thanks for being so helpful about this. Since you said a person must apply 30 days before the Kitas expires, and Mine expires June 10th. i will apply for the Kitap at the beginning of May.

I faced the same situation as you. Since your marriage was registered on May 25, they will count from the registration date, not the ceremony date, meaning you cannot get a KITAP yet.

You'll need to apply for a 1-year KITAS first. Then, next month, once your marriage reaches the 2-year mark, you can apply for a KITAP.

In my case, my marriage was registered on November 6, 2022, and my second 1-year KITAS was set to expire on November 28, 2024. Despite this, they didn’t grant me any relaxation. They told me that as of October 28, 2024, my marriage had not yet reached 2 years. When I asked if I could apply for KITAP on November 6 or 7, they said no because applications must be submitted at least 30 days before the KITAS expires.

You can try your luck by asking the immigration officer directly, but chances are they’ll give you the same answer. My immigration office was in Lombok.
