Deportation and blacklisting

Hi there

I am a newbie to this - and forums in general - so please excuse my lack of knowledge/etiquette etc :)
I have looked through this and other sites regarding my queries but to no avail so here goes....

I overstayed my tourist visa by 30 days due to ill health and banking issues.
I had a medical certificate stating I was not fit to fly, however, when I arrived at departures, airport immigration dismissed it and I was told I had to pay IDR 7.5 mil (which I didn't have) or go to immigration office in town and ask for deportation.

After a night at the airport, I went straight to immigration office next morning and after many hours I was finally told I could leave on the flight that evening.
Back at the airport, I was to meet an officer who had my passport and then escorted me through.
When he gave me my passport back, with a letter in Bahasa, he told me I had to come back to Jakarta in 6 months to 'clear my name' as I was now blacklisted.
(It was not possible for me to do this)

Therefore, I am asking for advice on what to do next, how to 'clear my name' and how deportation and blacklisting affects future travelling/visa application.

The deportation stamp on my passport is red not blue. Passport not due to be renewed until 2020.

Hopefully someone with more knowledge than I have will be along shortly, but meanwhile, here are questions for you that might have an effect on the best answers for your situation:

1. What do your future plans hold with respect to travel to Indonesia? Do you want to return soon, and if so, is it to live here or just for a visit?
2. Do you have any family in Indonesia?

I have never heard of having to return to Indonesia to "clear your name." I could be wrong, but my guess is that the officers were just messing with you.

...Also, if you want us to take a look at the letter they gave you, just take a photo with your cell phone and post a picture. A lot of people on the forum will be able to tell you what it says.

Welcome to the forum. Sorry to hear about your troubles.

Legally, blacklisting in Indonesia comes in two varieties, temporary and permanent. The temporary ones are by law limited to 6 months, but can be extended if requested by an official. If this is your first black listing, I imagine it is temporary.

Technically speaking, it should automatically clear up after 6 months, but in practice maybe some bored official extended it for no reason. To be 100% sure of your status you need to check with the Directorate General of Imigration (DirJen Im) at Jl. H. R. Rasuna Said Kav. 8-9, Kuningan, Jakarta Selatan, specifically the Direktur Penyidikan dan Penindakan Keimigrasian. The best way for you to do this is to have a friend/relative/agent go down there in person and find out. They have a phone and e-mail you can try, but don't be disappointed if no one responds. Call Center : (021) 5225029/ 5225028, Email : [email protected]

If you do send someone, it would be good if you at the same time prepare and have them bring an appeal to have the blacklist removed (in case that it is still enforced), and save them a trip.

Please understand that the removal from blacklist requires a sponsor to request this on your behalf. Usually a friend/relative/spouse etc. who has legal status in Indonesia. If you don't have one of those, maybe an Immigration agent maybe able to help.

Then they should go to the above office with:

- A "Permohonan Pencabutan Cekal" letter, signed on Rp 6000 materai. You can write a generic Permohonan letter. Your sponsor will probably know how, if not here is an article. Please ask for your specifics if necessary.

- Copy of your sponsor's KTP/Passport/ID

- Copy of your Passport, including all pages with stamps and the page with the blacklist stamp.

Then wait for the immigration officials to issue you a Surat Berakhir Masa Penangkalan (Letter of Blacklist termination). This letter can then be faxed to an Indonesian embassy where you apply for a new visa.

It's a lot easier to figure out a way to stay long-term if you have family, because then you can get a spouse-sponsored visa. However, finding a legal job so you can support yourself and family is only slightly easier if you are married to a local. But that's a problem you can deal with in the future if it eve arises.

Thanks Daniel. It was a group effort, which was part of the reason for the delay, so I can't take all the credit. Atlantis provided his excellent legal expertise, and the other team members worked on grammar/spelling and formatting.

Going forward, we expect our articles that appear in the law & immigration section to all have at least the same level of quality. Considering the subject matter, we think that quality accuracy is very important!

Very soon we will be publishing another article (gotta pace these things you know....), concerning new regulations from Immigration that have taken effect in 2016. As far as we know, no other news outlet or expat themed website/media has this information published yet.

1) The sponsor has to apply. The blacklisted person does not have legal status in Indonesia.
2) Yes
3) There is no mention of official fee that I can see anywhere...

May i ask, when is the right time to check with the Directorate general of Immigration? Right after 6 months or would it be better a week before the 6 months ban finish? thanks

Probably right at the 6 moth mark, give or take a day or two depending on if it would fall on the weekend or a holiday.
 
Hi All, On 5th Dec 2023, my office received a letter from immigration asking me along with my passport and contract, to be present at immigration office. They retained my passport on 6th dec 2023, with a finds;
a) My residential address shown as office address.
b) My designation in KITA do not match in my contract.
Upon personal follow-up, On 5th Jan 2024 I was informed that office will help to release the funds – I keep updating the same to Agent who was helping and ask him to manage immigration and buy time. Due to delay in this process. Finally on 24th Jan 2024, my office received deportation letter on my name from immigration. After again meeting with immigration, Agent mentioned. If my office want me back he can request “Tangkal” option with immigration for additional cost, provided there should be a return ticket for me. I told the Agent I do not want any Red stamp in my passport even if I am allowed to renter in few days, reason it might effect my future travel plans to different countries.
I want to know is there any optional Red stamps which still allow me to renter in fews days. Does internationally countries share their blacklisted name with each other or how badly can this red stamp ever effect me in future. I have a plan to apply for USA H1B sometime soon and I do not want this to be a blcoker.
Anybody in this forum and who reads this message. Please suggest or advice.

Deportation gets you a red stamp. Why should that not be case? Countries will ask you if you have even been deported. An honest answer should follow. I don't understand why you expect to be treated differently? Is there something I am missing?

b) What is KITA? What is your designation in KITA and what is in your contract?

My office in Jakarta and I work too in Jakarta. My KITAS shows as System engineering Manager, Where as in the contract it show Senior Technical Manager.
