Company KITAS to wife KITAP questions

I can't get a clear answer from the agent my company uses, except that they will charge double the normal price they charge for a kitas extension including a change of sponsorship. I think this is exorbitant so I figured I'll just do it myself, my previous experience with immigration getting the affidavit for my newborn was relatively painless, I wonder if this would be the same.

In saying that, I have contacted the Immigration advisor chat on their website to discuss, and their answers weren't entirely clear this time. As this forum has always been amazingly helpful, so I hope someone can help me through this maze of regulations.

I am currently on a company KITAS and work permit, and my goal is to get a KITAP sponsored by my wife through the 2+ years of marriage rule. My questions are:

1. Can I move from a company sponsored KITAS directly to a wife KITAP or do I have to do the wife sponsored KITAS first?

2. How long does a change of sponsorship take? Does anyone have a link to the steps involved or do I only send all the required documents to immigration and they'll process everything? The agent is saying there are several levels of approval needed that need to be chased yet immigration just gives me a very short list of documents and tell me to submit that (copy of all immigration documents I have now, request from my wife with materai, no objection letter from company with materai, that's it).

3. Does the change of sponsorship affect the KITAS duration? (My current KITAS expires in 2 months, is it wise to try to handle the sponsorship change prior to the extension, at the same time as or should I just let my company handle the normal extension and do the change myself with no rush afterwards)

4. Does the change of sponsorship affect my IMTA/RPKTTA as well as STM/SKTT (I am not moving my residence)? Is there anything that needs to be done on that front or after the change of sponsorship all is done?
 
Hello, Euc. I'm in the same boat as you (gathering information to go from company Kitas to wife Kitap) and I'll try to help.

1. I can confirm that it's a two step process. Company Kitas to Wife Kitas then Wife Kitas to Wife Kitap.

2. I think for this you need to do your own research and ask other agents for information (but don't tell your current agent) etc. to confirm what is being said to you is true. It's hard to argue against the double price considering there are two steps involved in the process. What I'm more focusing on is the "there are several levels of approval needed" comments which sounds to me like an attempt to discourage you and the lack of clear answer they are giving you.

If you have the wrong kind of agents, your switching over to a Wife Kitas and then to a Wife Kitap will be seen by them as a disruption to their income because they'll go from an annual revenue to a five-yearly revenue if you succeed to getting a wife Kitap. Not all agents are like this, but there are those who play the game this way. Try to dig deeper and see what "game" the agent your company is using is playing. Reality shouldn't be free of bureaucratic hurdles but it shouldn't be impossible either.

I know that when I started badgering my company's agent a little too much about this, they became uncommunicative with me and suddenly said that their agency didn't offer Kitap-related services (despite them being the ones to tell me I need to be married for 2+ years to qualify for a Wife Kitap).

3. From what I've gathered, you'll get 12 months when you change sponsorship.

4. This one, most of the answer given to me says that I have to resign from my job. The logic being that switching to a Kitas sponsored by your wife means that you're here for penyatuan keluarga (family unification) and not for working. Apparently it's quite a grey area and one I've yet to explore fully.

As far as I know, IMTA and a spouse sponsored visa are not compatible. I feel pretty sure about that. Kind of renders the rest of the questions moot, unless you are going to give up the work permit.

Edit: All wrong, apparently. I'll take mas_dam and centurion's word for it.

There is no problem. As long as you continue to be compliant on the work permit side and your company does everything as they always did with Kemnaker (RPTKA, DPKK, Notifikasi, Laporan Keberadaan etc.) everything is fine. At least for South Jakarta Immigration (2020) there seems to be also no mechanism or need to report your work permit docs/the fact that you work on spousal KITAS to immigration.

This is of course completely separated from the discussion that can be found in other threads concerning the question what kind of work would be tolerable under spousal KITAS without work permit (almost none formal work).

1. You have to move to wife-sponsored KITAS first.
2. Change of sponsorship is a couple of months process, especially in the pandemic time. Includes approval from the local Immigration Office (KanIm), Regional Immigration Office (KanWil), and Directorate General of Immigration (DirJen Imigrasi). The same application form/file goes through all these levels.
3. It is advisable to extend the company KITAS first. If you get the no objection letter you can do the process by yourself.
4. It does not affect. However, the employer(or their agent) has to submit the family papers proving that your KITAS is on the spouse sponsorship(KK, spouse KTP, valid marriage certificate) in the next work permit extension.

The way I understand it a KITAS is only a residence permit, it never allows you to work in a formal job. Who sponsors the KITAS (thus your residence in Indonesia) shouldn't matter for work as long as you got the work permit arranged separately.

Yes, that is what I was told by the agent as well, which was the time consuming and costly part.

I'll get the company to process my extension normally first and then I'll try to do the change of sponsorship somewhere later on.

Yes, the company will keep processing everything as normal, and I actually meant the other way around; to ensure that the new KITAS number matches the one on the kemnaker docs, not sure if this is a thing, will need to find out more details.

This is not an issue at Kemnaker as the normal flow is work permit --> KITAS.
Nevertheless, work permit follows the KITAS validity dates (without mentioning the number).

The same applies for Family KITAS. If you hold a family KITAS i.e. valid 11/2020-11/2021 and your company processes your (first) work permit this month 07/2021 it can be only valid util 11/2021, even if you are otherwise eligble to a 12 months work permit. Afterwards things should get synched automatically. This is at least my experience, still depends on the Kemnaker office etc. I assume.
 
Been a while, just picked-up my bright pink KTP, finally completing the process.

I actually only managed to start the whole process at the beginning of 2023, as I was transferring to a different business unit, I had to have my KITAS/IMTA redone anyway.

Managed to convince my company to pay the agent to put the KITAS under my wife's sponsorship (which for them would cost the same anyway so no issues there). I can now confirm that when changing sponsorship from company to wife the expiration date of the original KITAS remains valid.

Once that was done, I went to my local immigration office where they gave me a list of documents to be submitted, pretty standard list (attached, YMMV, mine is from Jakarta Pusat, could be that other areas have some different requirements. I also had to pay the day of submitting my application and not after approval was obtained as mentioned at the bottom of the list).

I submitted my application in July (2 months prior to KITAS expiration date) and was told to pay that same day before 3pm and come back the next day for picture taking. I did as request, and the next day after picture taking was told that "DirJen approval will take a while, just wait we will contact you". I received an e-mail that my KITAP was approved and ready for pick-up exactly 3 weeks later.

I then wasted some time with the silaporlagi website from dukcapil, which turns out requires the WNI to register the main account and then register him/herself as sponsor. I had registered myself as main account and tried to add my wife as sponsor, this was rejected, and I was informed the main account needs to belong to the WNI. I wasn't able to make an account for her (I suspect a previous agent did so already), since the dukcapil office is a 10 mins drive I figured I'll just go there in person. All of this was a waste of time to begin with because you can do the KTP-OA at the dukcapil office directly much faster anyway.

Took a while for me to find the time to escape the office for a bit, did so last Wednesday and was in and out in 20 mins, was told to pick-up my KTP-OA and KK in 2 days. Got someone to pick those up today and all is well in paradise.

Standard option seems to be to give the WNA a stand-alone KK, my wife didn't appreciate that and wanted me added to the main one, which was sorted through WA with the dukcapil office.

Some takeaways:

  • Not counting the time that I procrastinated in between it effectively took 3 weeks and 3 days to go from Wife sponsored ITAS to Wife sponsored ITAP with all the documents / cards required done (at least I hope I didn't miss anything).
  • 4 trips to the immigration office (1 time to get the information, 2nd time for submission, 3rd time for pictures, 4th time to pick-up passport and the actual kitap, all except the 3rd visit could be done by anyone with a "surat kuasa").
  • 2 trips to Dukcapil office (1st trip to apply, 2nd trip to pick-up KTP-OA/KK, 2nd trip can be done by anyone).
  • I only paid official fees (only at immigration, dukcapil was free).
  • You must be on spouse sponsored ITAS before you can move to spouse sponsored ITAP
  • I was, erroneously, under the impression that I needed a SKTT to get the KTP-OA and KK, this turned out not to be the case, KITAP doesn't need SKTT anymore. Don't waste time with silaporlagi and go to the office right away for the KTP-OA picture taking.
  • A++ for the teams at Jakarta Pusat immigration office as well as DKI Jakarta Dukcapil office, they did a brilliant job all the way.
  • Company HR/agent still handled the working permit stuff for me, didn't seem to affect anything though, except for the agent being a bit grumpy with me for "missing out" on the ridiculous 30jt quote (he said and I quote: "ITAS costs 10jt per year, ITAP is valid for 5 years, so you're saving 20jt". Told him thanks but no thanks).

I was willing to pay because 30 jt was fresh air compared to a previous agent who just said "Nope, can't be done, your only option is Kitas" and got away with it for a few years because I only had my suspicion to rely on.

Renewed regular ITAS under company sponsorship in Sept 22, changed to wife sponsorship in February 23 (kept the same expiration date from the Sept 22 extension: Sep 23), applied ITAP under wife sponsorship July 23.

If so that's very interesting.
Why is that interesting? I would think that a KK is designed to put all members of the 'keluarga' on 1 'kartu', right?

I always had a separate KK until last KTP renewal. CatSip combined ours to one and said that this is the only way possible now. Wife us head of household on KK. Maybe new way, maybe this guys way. Who knows?

I also have a separate KK, but as soon as my wife and I sold our house in Cikupa we will change our address to Jakarta. In doing so, we will arrange for a KK with both our names on it.
This was one of the conditions, as I remember from another thread, to apply for BPJS.

I work in a large publicly listed company who aren’t going to push the envelope, neither am I particularly inclined to find out what the limits are.

Company HR / agent guy organized the working permit, haven’t heard of any changes in requirements vs previous.

To my knowledge permit should be required if working in a formal job anyway.

the same. the only difference is that they won't bother getting you a KITAS. but all the docs and hassle for work permit is the same.
 
If I'm on a spouse-sponsored ITAS that means that istri ku must support me, correct? 😎 (y)
