Alih sponsor from workplace to spouse requires resigning from workplace?

Hello all. Just wanting to get some information on his.

I'm presently on a KITAS sponsored by workplace and am looking to alih sponsor to KITAP sponsored with my WNI spouse (been married to her 4.5 years).

I went to the immigration office prior to the pandemic to ask if I had fulfilled the requirements and what documents that I had to provide. The thing that made me slightly raise my eyebrows was that the customer service officer that I asked questions to said that I had to resign from my workplace if I wanted to do alih sponsor to my spouse.

Looking around at the information on websites and the big board outlining what documents are required only said "surat pengunduran diri (bila sudah resign)" but this implies it's only required if I have resigned, which I haven't.

My questions are:

1. Do I have to resign from the workplace to do alih sponsor to my spouse? (Just want to make sure because if it was the only information from the immigration customer service that seemed to be at odds with what I've read)

2. Can I directly convert KITAP sponsored by workplace to KITAP sponsored by spouse? I ask this because the stories of people getting a KITAP sponsored by spouse start off with the WNA having a Kitas sponsored by spouse instead of on a visa sponsored by the workplace.

Obviously the immigration's closed and my KITAS becomes an emergency permit until the national disaster status has been lifted. But just wanted to make some preparations.

They are probably operating on the (unproven?) assumption that you can not work under a spousal visa, so "of course" you must resign. It will likely be a long and painful process to push against that, even if you may truly come out successful.
 
I'm certain there were cases of Spousal sponsored KITAP + IMTA reported in this forum, so I don't think resigning is necessary.

Actually this is exactly their reasoning. I’ve been in contact with the Kantor Imigrasi I’m registered at via their twitter account the last few days. They confirmed what the immigration customer service officer said months ago to me that I had to resign if I wanted to alih status to being sponsored by my wife.

The reasoning here is because being sponsored by a spouse means that I’m here for “penyatuan keluarga” but not for work.


I'm certain there were cases of Spousal sponsored KITAP + IMTA reported in this forum, so I don't think resigning is necessary.

Long answer: Company-sponsor has to approve your change of status, no need to resign.

2. Short answer: Yes
Long answer: If you have KITAS now, you can go to spouse KITAS then apply for KITAP.
Alternatively, if you already have work KITAP now, convert to spouse KITAP.
 
You can definitely work on a spouse KITAS with an IMTA. The regulation was issued a few years ago and people have done it.
But whether you can move from spouse KITAS to work KITAS while still working at the same job with no interruption in the IMTA, is not clear. It is probably quite rare. The best thing normally is to read the relevant laws and regulations and see what they say.

Yes, you can move freely without interrupting the work permit. The company will issue an approval letter that they are consent to release the KITAS sponsorship in favour of the spouse while staying on the company's work permit, now called SK Notifikasi(ex IMTA).

Future extensions of the work permit have to be supported by documents that the worker is on a spouse KITAS,
